Dave Trabert with the Kansas Policy Institute wrote an article this week for their online publication, <a href="https://sentinelksmo.org/covid-vaccines-should-go-to-elderly-before-prisoners/">the Sentinel</a>, that questions the thought process by Governor Laura Kelly in looking to vaccinate the prison population in Kansas before some of the elderly population.

"Governor Kelly has been saying for a couple of weeks now that she thinks prisoners should be ahead of the elderly," Trabert said. "They live in close proximity to each other and we don't want it to spread in prisons, so we should inoculate them before we inoculate the elderly. This is just not supported by the data."

Here in Reno County, of the 105 deaths reported through January 6, 41 are attributed to long-term care facilities, which generally include the elderly. Only three prisoners have died and now there are only five active infections as of the 6th.

"If you look at number of cases, you look at the rate of hospitalizations, the survival rate, everything, it unquestionably supports putting the elderly first. You want to inoculate the most vulnerable and that would include any elderly prisoners."

When looking at the statewide numbers, the risk isn't close.

"0.2% of the cases in correctional facilities are attributed to a COVID death, versus 16% for adults 85 plus. That makes adults 85 plus eighty times more likely to die than residents of correctional facilities."

The latest KDHE numbers say that as of January 3rd, the overall survival rate from COVID in Reno County is 98.5%.

Trabert: Data does not support vaccinating prisoners before elderly

HUTCHINSON, Kan. — The Reno County overall case count is at 507 as of Wednesday afternoon. The death count among Reno County residents is at 105.

The Correctional Facility cluster type has five active cases measured by the county's COVID-19 dashboard. The Long Term Care Facility cluster type has 73 active cases. Forty-one people within those clusters have died. There are 40 active clusters in the county.

Out of 6,804 total cases since the beginning of the pandemic, there are 506 cases in the community at large. 6,192 people have recovered thus far.

Twenty-one Reno County residents are in the hospital. Three hundred seventeen total have been hospitalized. Ninety-six have been admitted to the ICU and 31 have been intubated. These are Reno County resident numbers regardless of where they are hospitalized.

The community's positive test rate is at 27.24%, with the overall positive test rate at 32.44%. 33.37% of the population has been tested.

There are now two free public testing sites, one in the Cosmosphere parking lot in Hutchinson and one at Simply Good Overstocks parking lot in South Hutchinson. They are open Monday through Saturday from 8 a.m. to 5:30 p.m.

Community case count back above 500 as of Wednesday afternoon

RENO COUNTY—One person was injured in an accident just before 4 p.m. Wednesday in Reno County.

The Kansas Highway Patrol reported a 2014 Peterbilt semi driven by 30-year-old Jesse Daniel Lamb of Inola, OK., was&nbsp;eastbound on U.S. 50 at the Kansas 61 Junction, when the semi veered to the right, struck a guard rail and bridge rail. The semi traveled into the south ditch where it rolled, struck a power pole and a fence before coming to rest.

EMS transported Lamb to Hutchinson Regional Medical Center. He was not wearing a seat belt, according to the KHP.

Driver hospitalized after semi rolls, strikes power pole

NEWTON —The Harvey County Health Department, in conjunction with the Harvey County Sheriff’s Office, has confirmed a cluster of COVID-19 cases in the Sheriff’s Office facility.

The cluster includes five employees. Two additional test results are pending. The individuals confirmed to have COVID-19 are in isolation. The Health Department will regularly monitor the health of the individuals. Those identified as close contacts have been notified.

“Public safety is always our priority, and for some of our staff right now, that means being at home,” said Harvey County Sheriff Chad Gay. “We have excellent law enforcement agencies throughout Harvey County that help us ensure the same level of response will be maintained for our communities. I hope our staff has a safe and healthy recovery.”

The isolations are not anticipated to disrupt law enforcement services in the county. All individuals confirmed to have COVID-19 or identified as close contacts remain at home, away from interaction with the public.

“COVID-19 continues to challenge our communities, and that can include our health care professionals, first responders and other emergency services,” said Harvey County Health

Department Director Lynnette Redington. “It’s essential everyone takes appropriate precautions to reduce the spread of COVID-19.”

The cluster will be considered active until there are 28 consecutive days – two incubation periods – without positive cases.

Harvey County confirms COVID-19 cluster at Sheriff’s Office

HUTCHINSON, Kan. — Hutchinson Regional Medical Center (HRMC) announced Wednesday it is cautiously reopening surgery to include elective cases. 

The non-emergency procedures&nbsp; have been postponed recently because of the COVID-19 crisis. Patients should talk with their doctors about scheduling procedures. The hospital has instituted procedures that will provide patient safety.

The hospital also announced that the vaccine deployment to health care providers is going well. So far, the hospital has provided nearly 600 vaccinations of both Pfizer and Moderna vaccines.&nbsp;

Three weeks ago, the hospital gave out 257 Pfizer vaccines and started second doses on Jan. 5. One hundred doses of Moderna were given on Jan. 5 with an additional 100 on Wednesday.

HRMC estimates 870 total first vaccinations will be given by the end of this week.&nbsp;

The Senate has resumed debating the Republican challenge against Democrat Joe Biden’s presidential election victory, more than six hours after pro-Trump mobs attacked the Capitol and forced lawmakers to flee.

Scores of Republican representatives and 13 GOP senators had planned to object Wednesday to the electoral votes of perhaps six states that backed Biden. It was unclear whether those objections would continue in light of the day’s violent events.

President Donald Trump has falsely insisted that the election was marred by fraud and that he actually won. He reiterated those claims in remarks to thousands of protesters outside the White House early Wednesday and goaded them to march to the Capitol, which many of them did.

The mayhem had forced the House and Senate to abruptly end the day’s debates and flee to safety under the protection of police. And it prompted bipartisan outrage as many lawmakers blamed Trump for fostering the violence.

Former Defense Secretary Jim Mattis, who resigned in protest over President Donald Trump’s Syria policies, blamed the president for the violence at the U.S. Capitol.

In a sharp rebuke Wednesday, Mattis said the violence was fomented by Trump, who has used the presidency “to destroy trust in our election and to poison our respect for fellow citizens.”

His written statement concluded, “Our Constitution and our Republic will overcome this stain and We the People will come together again in our never-ending effort to form a more perfect Union, while Mr. Trump will deservedly be left a man without a country.”

Mattis, a retired four-star Marine general who stepped down as Pentagon chief in December 2018, had an embattled relationship with Trump, but largely remained publicly quiet and avoided direct criticism. Since he left the job, however, he has been more openly derisive of Trump, including a pubilc condemnation of the president’s heavy-handed use of military force to quell protests near the White House last June.

Stephanie Grisham, chief of staff and press secretary for first lady Melania Trump, has resigned following violent protests at the U.S. Capitol by supporters of President Donald Trump.

Grisham says in a statement Wednesday that it was an “honor” to serve the country in the White House and be part of he first lady’s “mission” to help children.

Grisham was one of Trump’s longest serving aides, having joined the campaign in 2015. She served as the White House press secretary and never held a press briefing.

Wednesday’s violent occupation of the U.S. Capitol by the president’s supporters sparked renewed conversations inside the White House about mass resignations by mid-level aides who are responsible for operations of the office of the president.

Two people familiar with the conversations said the aides were torn between fears of what more would happen if they left and a desire to register their disgust with their boss. They spoke on condition of anonymity to discuss internal matters.

The Republican National Committee says it strongly condemns the violence at the Capitol, adding that the violent scenes “do not represent acts of patriotism, but an attack on our country and its founding principles.”

The RNC is responsible for developing and promoting the Republican political platform. Its statement condemning the violence came hours after Republican President Donald Trump baselessly complained that the election was stripped away “from great patriots.” He went on to tell them to “go home with love &amp; in peace.”

The group’s communications director, Michael Ahrens, says, “What happened today was domestic terrorism.”

He says to see the U.S. flag used “in the name of unfounded conspiracy theories is a disgrace to the nation, and every decent American should be disgusted by it.”

He held a rally earlier Wednesday and urged his supporters to march to the Capitol, telling them to “get rid of the weak Congress people.”

Former President Bill Clinton says the attack on the U.S. Capitol was fueled over four years of “poison politics” and lit by President Donald Trump.

Clinton said in a statement Wednesday night that the riot at the Capitol resulted from a combination of deliberate disinformation that created distrust in the system and pit Americans against one another.

He wrote, “The match was lit by Donald Trump and his most ardent enablers, including many in Congress, to overturn the results of an election he lost.”

His wife, Hillary Clinton, lost a bitter election to Trump in 2016 and conceded to him immediately. Trump has refused to accept his defeat by Democrat Joe Biden in November and is trying to cast him as an illegitimate president.

Trump had encouraged his supporters to come to Washington to fight Congress’ formal approval of Biden’s win. He held a rally earlier Wednesday and urged his supporters to march to the Capitol, telling them to “get rid of the weak Congress people” and saying, “get the weak ones get out; this is the time for strength.”

House Speaker Nancy Pelosi says Congress will resume the Electoral College proceedings once the Capitol is cleared of pro-Donald Trump protesters and safe for use.

Pelosi said she made the decision Wednesday in consultation with the Pentagon, the Justice Department and the vice president, who will preside.

She noted the day would always be “part of history,” but now it would be “as such a shameful picture of our country was put out into the world.”

Dozens of pro-Trump protesters remain on the streets of the nation’s capital in defiance of the curfew imposed after rioters stormed the Capitol.

The mostly maskless crowd was forcibly removed from the Capitol on Wednesday after breaking into the building and halting the constitutional process of voting to certify President-elect Joe Biden’s win. They were pushed out of the immediate area and moved down the hill, where they taunted law enforcement and moved barricades.

Police said anyone found on the streets after the 6 p.m. curfew would be arrested. Officers in full riot gear with shields lined the streets near the U.S. Capitol.

House Speaker Nancy Pelosi said their debate on affirming Biden’s victory would continue after the Capitol was secured.

A West Virginia lawmaker took video of himself and other supporters of President Donald Trump rushing into the U.S. Capitol after they breached the security perimeter.

In the video by Republican Del. Derrick Evans, later deleted from his social media page, he is shown wearing a helmet and clamoring at the door to breach the building in Washington, D.C., on Wednesday.

“We’re in! Keep it moving, baby!” he said in a packed doorway amid Trump followers holding flags and complaining of being pepper sprayed. Once inside, Evans could be seen on video milling around the Capitol Rotunda, where historical paintings depict the republic’s founding, and yelled, “No vandalizing!"

State House of Delegates Speaker Roger Hanshaw said Evans will need to “answer to his constituents and colleagues regarding his involvement in what has occurred today.”

He said he has not spoken to Evans yet about his involvement.

The delegate from Wayne County said in a statement later on Facebook that he was heading back to West Virginia and “was simply there as an independent member of the media to film history.”

A woman who was shot inside the U.S. Capitol during the violent pro-Trump protest has died.

That’s according to two officials familiar with the matter who spoke to The Associated Press on Wednesday on condition of anonymity because they weren't authorized to speak publicly.

The Metropolitan Police Department said it was taking the lead on the shooting investigation. Police did not immediately provide details about the circumstances of the shooting.

Dozens of supporters of President Donald Trump breached the security perimeter and entered the Capitol as Congress was meeting, expected to vote and affirm Joe Biden’s presidential win. They were seen fighting with officers both inside the building and outside.

Hours later, police had declared the Capitol was secured.

WASHINGTON (AP) — Violent protesters loyal to President Donald Trump stormed the U.S. Capitol on Wednesday and forced lawmakers into hiding, in a stunning attempt to overturn America’s presidential election, undercut the nation’s democracy and keep Democrat Joe Biden from replacing Trump in the White House.

The National Guard and state and federal police were called in for control, and the mayor of Washington imposed a rare evening curfew. One person was reported to have been shot.

The protesters were egged on by Trump and his false attacks on the integrity of the November presidential election. While rallying his supporters outside the White House Wednesday morning, he urged them to march to the Capitol. But later — hours after they fought police and breached the building — he told them that although they were “very special people” and he backed their cause, they should “go home in peace.”

President-elect Biden, two weeks away from being inaugurated, had declared in Wilmington, Delaware: “I call on President Trump to go on national television now to fulfill his oath and defend the Constitution and demand an end to this siege,”

Biden said that democracy was ’“under unprecedented assault,” a sentiment echoed by many in Congress, including some Republicans.

The chaotic protests halted Congress’ constitutionally mandated counting of the Electoral College results, in which Biden defeated Trump, 306-232.

Republican Senate Majority Leader Mitch McConnell had tried to steer Congress away from Wednesday’s formal protest of those results, and he said at the start of proceedings that Trump had clearly lost.

Wednesday’s ordinarily mundane procedure of Congress certifying a new president was always going to be extraordinary, with Republican supporters of Trump vowing to protest election results that have been certified by the states. But even the unusual deliberations, which included Vice President Mike Pence and Senate Majority Leader McConnell defying Trump’s demands, were quickly overtaken by the chaos.

In a raucous, out-of-control scene, protesters fought past police and breached the building, shouting and waving Trump and American flags as they marched through the halls. One person was reported shot at the Capitol, according to a person familiar with the situation. That person’s condition was unknown. At least one explosive device was found that was detonated.

The protesters abruptly interrupted the congressional proceedings in an eerie scene that featured official warnings directing people to duck under their seats for cover and put on gas masks after tear gas was used in the Capitol Rotunda.

Senators were being evacuated. Some House lawmakers tweeted they were sheltering in place in their offices.

The Pentagon said about 1,100 District of Columbia National Guard members were being mobilized to help support law enforcement at the Capitol.

Pence was closely watched as he stepped onto the dais to preside over the joint session in the House chamber.

Pence had a largely ceremonial role, opening the sealed envelopes from the states after they are carried in mahogany boxes used for the occasion, and reading the results aloud. But he was under growing pressure from Trump to overturn the will of the voters and tip the results in the president’s favor, despite having no legal power to affect the outcome.

“Do it Mike, this is a time for extreme courage!” Trump tweeted Wednesday.

But Pence, in a statement shortly before presiding, defied Trump, saying he could not claim “unilateral authority” to reject the electoral votes that make Biden president.

Despite Trump’s repeated claims of voter fraud, election officials and his own former attorney general have said there were no problems on a scale that would change the outcome. All the states have certified their results as fair and accurate, by Republican and Democratic officials alike.

Arizona was the first of several states facing objections from the Republicans as Congress took an alphabetical reading of the election results. Then the chaos erupted.

The Pentagon says about 1,100 D.C. National Guard members are being mobilized to help support law enforcement as violent supporters of President Donald Trump breached the U.S. Capitol.

Pentagon spokesperson Jonathan Hoffman said Wednesday afternoon that defense leaders have been in contact with the city and congressional leadership.

A defense official said all 1,100 of the D.C. Guard were being activated and sent to the city’s armory. The Guard forces will be used at checkpoints and for other similar duties and could also help in the enforcement of the 6 p.m. curfew being implemented tonight in the city.

The officials said the D.C. request for National Guard was not rejected earlier in the day. Instead, according to officials, the Guard members have a very specific mission that does not include putting military in a law enforcement role at the Capitol. As a result, the Guard must be used to backfill law enforcement outside the Capitol complex, freeing up more law enforcement to respond to the Capitol.

Hoffman said the law enforcement response to the violence will be led by the Justice Department.

The Department of Homeland Security is sending additional federal agents to the U.S. Capitol to help quell violence from supporters of President Donald Trump who are protesting Congress’ formal approval of President-elect Joe Biden’s win.

A spokesperson told The Associated Press on Wednesday that officers from the Federal Protective Service and U.S. Secret Service agents are being sent to the scene. He says they were requested to assist by U.S. Capitol Police.

MANHATTAN, Kan. — The formal phase public hearing to address the City of Wichita’s proposed modifications to Phase II of the Aquifer Storage and Recovery (ASR) Project will resume in early February.&nbsp;

The hearing will begin on Wednesday, Feb. 3, and continue as needed on Feb. 4, Feb. 5, Feb. 18 and Feb. 19. The proceedings will begin at 8:30 a.m. and will end each day no later than 4:30 p.m., except on Feb. 5, when they will end at noon.

Because of the COVID-19 pandemic, the hearing will be held partially in person and partially virtually. In-person proceedings will take place at the Kansas Learning Center for Health in Halstead and will be open only to certain formal parties to the proceedings. The in-person hearing location will not be open to the public. The public will be able to view the hearing proceedings virtually using either Zoom or YouTube.&nbsp;

Officials with the Equus Beds Groundwater Management District in Halsted have been in opposition to the proposal because they feel it gives the city too much leeway without enough oversight as to how they take water from the aquifer, especially during drought.&nbsp;

In-person proceedings will take place at the Kansas Learning Center for Health in Halstead and will be open only to certain formal parties to the proceedings. The in-person hearing location will not be open to the public. The public will be able to view the hearing proceedings virtually using either Zoom or YouTube.&nbsp;Officials with the Equus Beds Groundwater Management District in Halsted have been in opposition to the proposal because they feel it gives the city too much leeway without enough oversight as to how they take water from the aquifer, especially during drought.&nbsp;

Haviland, KS – Dr. Royce Frazier, President of Barclay College, announced that the school has exceeded the $800,000 goal to begin the accreditation process for a new nursing program. “I am pleased to announce that at the end of November Barclay College has received $1,003,000 toward the startup of the new nursing program. It is evident that the college is moving into a new era in the 21st century through the vision of our board, the support of the Barclay College family, and the work of God.

The goal of $800,000 for a program startup was a sizable challenge. However, the resulting support came from both individuals and from the area medical community. Pratt Regional Medical Center and Kiowa County Hospital gave significant gifts toward the new nursing program.

Susan Page, President and CEO, Pratt Regional Medical Center, said, “We absolutely support Barclay College's initiative to establish an accredited nursing program that could be so beneficial for the residents of Southwest Kansas! We stand ready to assist in any way we can.”

The results have exceeded expectations. Larry Lewis, VP for Institutional Advancement noted, “I think that there was such a strong response to our nursing program because people see it as a real need in southwest Kansas, and it’s a great way to increase student enrollment at Barclay College.” Lewis added, “The underlying message is that people see value in having a nursing program from a Christian perspective. Not only are we helping fill the void in the nursing field, but we can do it by being Christ’s hands and feet to those we care for.”

The college hired Kim Hansen, B.S.N., M.S.N, as the new Director of Nursing Education in July 2019 to begin the accreditation process for the program. Reflecting on the generous outpouring of support Hansen observed, “The blessing in starting a nursing program at Barclay College is not only that we can help to fulfill this need, but our students will graduate with a major in Nursing and in Biblical Studies, combining faith and nursing. Our program's mission will be to graduate highly competent, ministry-minded nurses who contribute to a diverse global community through effective Christian life, service, and leadership.

In the fall board meeting of 2019, the Board of Trustees approved the launching of the quest to start a nursing program at Barclay College. The challenge had been discussed for many years, maybe decades, but had always faltered when it came to funding. Courageously, the Board of Trustees determined to take the necessary steps to ensure the success. Board members gave the initial gifts and pledges that totaled nearly $100,000 to launch the march toward a nursing program goal.

“Both supporters and people in the medical profession affirm that an institution that is committed to both faith and healing has a relevant place in our culture and our world today,” remarked President Frazier. “I think we are only seeing the beginning of what might be a new direction for the college. kicked off the new year with the usual housekeeping chores. The Council
appointed Matt Nisly as the city’s Mayor and the Council president is now
Tyler Graves.

The Council then made the yearly appointments with all
positions gaining approval. The appointments include new City Clerk Kara
Nielsen and Police Chief Darrin Pickering who will begin his first full year in
the position.

The Council also approved moving the meetings scheduled for
January 18th and September 6th to the following Tuesday
due to holidays.

once popular video chain announced Wednesday that it was closing the remaining
250 stores including the one in Hutchinson.

Each store will hold liquidation sales, offering deals on
movies, video games, CBD products and store fixtures.

Like other video store chains streaming services and other
online rivals ate into business. &nbsp;But the last stake through the heart was
the pandemic driven shutdown in March along with the shutdown of most filming
and production of movies.

Founded in 1978, the chain started in 2020 with 510
locations, but had to close roughly half by the end of the summer.&nbsp;

Kan. — Buhler USD 313 Superintendent Cindy Couchman said some employees in her district that are high risk have already received a dose of the COVID-19 vaccine.

"We did get to schedule some vaccine on Monday for most at risk staff that wanted the vaccine," Couchman said. "We sent out a survey asking if they wanted it. We are not requiring the vaccine, but if you wanted it and what risk factors you had, how old you were, if you had comorbidity risk factors. We were able to vaccinate everyone that wanted the vaccine that was high risk."

There were also a handful of employees that work in the schools that are not technically solely USD 313 employees that were vaccinated, too.

"We also opened it up to our RCEC, which is our Reno County Educational Co-Op," Couchman said. "In Buhler, we took some of the at-risk faculty from there. Although they're not actually employed by Buhler, they're employed by RCEC, which is our special ed Co-Op. I would say, maybe 80 Buhler staff members were, in addition to some RCEC staff members."

Buhler was first to get a date set, but the plan is to vaccinate some employees from each of the county's school districts.

"Joy was really the word to be used," Couchman said. "I've never seen so many people so excited about coming and getting a shot in the arm. I can't tell you how thankful we are to Reno County Health Department, because they did make education one of their priorities."

Couchman said she doesn't know the schedule, but she presumes other districts will be setting up clinics this week for their high risk groups.

"What we're proposing is four courts in the existing Rice Park tennis court facility," said Justin Combs, Director of Parks and Facilities. "We would go in and cut out the asphalt. The asphalt is in really poor condition. The pads would measure 55 feet long by 26 feet wide and pour those to new concrete."

The cost is about $5500 per court, or just under $22,000 for the four proposed with a replacement of the gates for about another $1000, or a total of just less than $23,000.

"These courts will feel like a concrete pad cut into old asphalt," Combs said. "They're not going to feel like a brand new, nice facility. I was trying to meet the immediate need, kind of relieve that pressure that we're feeling to meet this need, but not over invest in a court system that's definitely not going to satisfy the needs. It's always going to feel a little thrown together."

Combs believes that more will need to be done, but it needs to go through the normal process. Since this didn't, they looked for other funding sources.

"The Hutch Rec Foundation was excited about the project," Combs said. "They did offer $3500 in support, matching funds to privately raised funds. The private group, the pickleball community has already raised $1200, so that total support, the $3500 with the match, would be $7000, so then, the cost to the city would be approximately $16,000."

The intent is to look at more courts in future years through the regular budgeting process.

More pickleball courts coming to Hutchinson after City Council action Tuesday

HUTCHINSON, Kan. — The Reno County overall case count is at 459 as of Tuesday afternoon. The death count among Reno County residents is at 105.

The Correctional Facility cluster type has eight active cases measured by the county's COVID-19 dashboard. The Long Term Care Facility cluster type has 74 active cases. Forty-one people within those clusters have died. There are 40 active clusters in the county.

Out of 6,712 total cases since the beginning of the pandemic, there are 455 cases in the community at large. 6,148 people have recovered thus far.

The community's positive test rate is at 27.24%, with the overall positive test rate at 32.26%. 33.10% of the population has been tested.

HPD promotes 2 officers

HUTCHINSON, Kan. — The future of the Salt City Splash was discussed at length during Tuesday's Hutchinson City Council meeting. The discussion came during the year-end report from Hutch Rec, who oversees operation of the pool.

Hutch Rec's Tony Finlay says they are preparing to have a study done on the needs of the pool.

“We listed some dollar amounts on a few of the items,” Finlay said. “It’s really a need for the aquatics study that we’re partnering with the city on for this year.” Finlay says that could include a whole new aquatic center.

“Do we really invest in what these items are, maintain that current facility or should we look at a newer facility?” Finlay said.

Finlay says they hope to have the study underway during the summer while the pool is open, adding that, while a possible upgrade to the pool would be beneficial, the location of the Splash is not user friendly.

“Our attendance for the size of the facility we have and the size of the community that we have, we are not meeting attendance rates,” Finlay said. “There’s no other indication to me. The facility’s safe, it’s kept clean, always marketed, always have great evaluations on the facility itself, but it's hard to get to that facility.”&nbsp;&nbsp;

Parks Director Justin Combs says they are ready to send out requests for proposals for the study and hope to have that sent out soon.

“In that we’ll have a lot of community engagement,” Combs said. “So there will be some surveying on who is using the pool, how often are they using the pool, how are they getting to the pool? Just get a better understanding of the current use of the pool.”

In the meantime, Combs says they are working to address the short-term needs of the pool while preparing for the study.

“What we’re seeing is an aging facility, it’s still safe and still operates,” Combs said. “But we’re getting to a point we need to kind of decide, do we reinvest in Salt City Splash or do we move in another direction?”

The pool generated $204,430 over the summer and had $44,305 in subsidies from the city. Total attendance was down to 33,958 because of the pandemic.

City Council discusses future of aquatic center

HUTCHINSON, Kan. — Kansas U.S. Senator Dr. Roger Marshall has faced some tough decisions as a physician and he drew on that experience in making his first tough decision in his new office about choosing to object to the certification of some slates of electors when the topic comes up on Wednesday.

"A young lady who, I delivered three of her babies, she was in her late twenties and I had to tell her she had metastatic breast cancer," Marshall said. "With that diagnosis, it's not a good prognosis. There's not a black and white treatment plan. But, the first thing I want to do is I want to gather all the facts. I want to get a second and third opinion."

Marshall sought counsel from his now colleagues.

"I'm not a Constitutional lawyer," Marshall said. "I did talk to the Mike Lees and the Ted Cruzes of the world up here in Constitutional law. I read the Constitution, the relevant parts of it, several times. Much like that patient I was trying to talk to, this is a decision of the heart."

Marshall doesn't know for sure how much wrong there is or isn't, but he wants to find out.

"I feel like our U.S. Constitution was violated," Marshall said. "I took an oath to defend the U.S. Constitution. The U.S. Constitution gives the states the right, the requirement that the state legislators write the rules for how to conduct a Presidential election."

 </figure>By NICK GOSNELLHutch PostHUTCHINSON, Kan. — Kansas U.S. Senator Dr. Roger Marshall has faced some tough decisions as a physician and he drew on that experience in making his first tough decision in his new office about choosing to object to the certification of some slates of electors when the topic comes up on Wednesday."A young lady who, I delivered three of her babies, she was in her late twenties and I had to tell her she had metastatic breast cancer," Marshall said. "With that diagnosis, it's not a good prognosis. There's not a black and white treatment plan. But, the first thing I want to do is I want to gather all the facts. I want to get a second and third opinion."Marshall sought counsel from his now colleagues."I'm not a Constitutional lawyer," Marshall said. "I did talk to the Mike Lees and the Ted Cruzes of the world up here in Constitutional law. I read the Constitution, the relevant parts of it, several times. Much like that patient I was trying to talk to, this is a decision of the heart."Marshall doesn't know for sure how much wrong there is or isn't, but he wants to find out."I feel like our U.S. Constitution was violated," Marshall said. "I took an oath to defend the U.S. Constitution. The U.S. Constitution gives the states the right, the requirement that the state legislators write the rules for how to conduct a Presidential election."Marshall says at least four states violated their own law and he'd like to see further investigation into the matter and that's the reason he will be one of the Senators to object.
