HUTCHINSON, Kan. — On November 14th, 2023, a Reno County jury awarded a former Reno County resident $11,138,422.40 in damages for medical expenses and non-economic damages resulting from a skid steer accident, finding that Kubota’s SVL-90 skid steer failed to adequately warn of a crush hazard that paralyzed the resident.

The jury trial arose from an accident that happened on farm ground in rural Reno County on November 10, 2013. The plaintiff, Kolton Kincaid, was caught between the skid steer’s cab roof overhang and the grapple bucket while it was being raised, resulting in damage to his spinal cord.

Kubota wholly denied any wrongdoing and fought the case for nearly 8 years, claiming that the general safety instructions in the cab of the skid steer and in the operator’s manual were sufficient notice of the hazard. 

There were no specific warnings about the crush point, and the jury found that the general safety instructions were vague and inadequate given that Kubota either knew or should have known about the hazard in their safety testing and development of the SVL-90. Kubota did not produce and present any safety testing information in its defense.

Before trial, Kubota offered $30,000.00 to settle the case.

Kincaid declined the offer and opted for a jury trial. His attorneys Michael Wyatt and Jesse Tanksley, law partners with Mann Wyatt Tanksley Injury Attorneys, successfully argued during the five-day trial that the defendant was significantly at fault for the accident, and that because of Kubota’s negligence, Kincaid sustained severe and permanent injuries that significantly affected his life and will require life-long medical treatment. The jury agreed and awarded Kincaid a total verdict of $11,138,422.40 for his past and future medical expenses, and his pain, suffering, and mental anguish. The verdict was more than 370 times the amount that Kubota had offered before trial.

They tried to avoid responsibility for the accident and directed the blame at everybody else, but the jury didn’t let them get away with it. We are so grateful for our client’s courage and perseverance in allowing us to litigate and try his case to a jury. Tanksley, a fellow Mann, Wyatt &amp; Tanksley partner, said the ultimate goal of taking Kolton’s case to trial was to publicly hold Kubota responsible for its negligence and ensure that Kolton recovered the money that he would need to pay for his medical treatment and interest in paraplegia advocacy and adaptive sports. Wyatt and Tanksley said they were proud of the fact that Kubota will be forced to look at its safety practices and the process of developing warnings to prevent deaths and catastrophic injuries like this.

HUTCHINSON, Kan. — The Hutchinson Art Center's Holiday Open House has become an annual event.

"This is, I believe, our fifth year," said board member Barbara Withrow. "It's been a lot of fun. It's sort of a little mini art fair. There's a lot of that at this time of year. I think, when people get out to shop, come by and see us. There's a lot of available merchandise all over town and we know that. We want to be part of the party."

Saturday from 10:00 a.m. to 3:00 p.m. will be the perfect opportunity to shop for one-of-a-kind creations, including jewelry, pottery, paintings, handmade holiday cards, and more.

"We have, right now, 12 people who are coming," said Art Center Director John Eberly. "This is including two of our wonderful staff at the Art Center, Emily Kohls and Rachel Hindle. I think it's going to be a terrific event."

It's an opportunity for local artists to show off their creativity and talent.

"These people study to do this," Withrow said. "It isn't something, you wake up in the morning and say, oh, I think I'll make jewelry today. These people practice, they go to workshops, they learn how to do this and they perfect those skills."

The Hutchinson Art Center is at 405 North Washington.

Art Center hosting Holiday Open House

HUTCHINSON, Kan. — The unemployment rate in Reno County rose for the month of October 2023.

According to the Kansas Department of Labor, the jobless rate for the county went up four tenths of one percent to 3.3%. The jobless rate for the same period in 2022 was 3.0%.

There were 956 county residents out of work.&nbsp;

Preliminary estimates reported by the Labor Market Information Services (LMIS) division of the Kansas Department of Labor (KDOL) and the Bureau of Labor Statistics (BLS) show a&nbsp;<a href="https://klic.dol.ks.gov/admin/gsipub/htmlarea/uploads/Press%20Release/LR%20Oct2023%20SA%20Rate%20Chart%20File.pdf">seasonally adjusted unemployment rate</a>&nbsp;of 2.9% in October. This is an increase from 2.8% in September and a decrease from 3.0% in October 2022.

Seasonally adjusted job estimates for Kansas indicate total nonfarm payroll employment increased by 3,200 from September. Total nonfarm includes private sector and government employers.&nbsp;<a href="https://klic.dol.ks.gov/admin/gsipub/htmlarea/uploads/Press%20Release/LR%20Oct2023%20SA%20PrivateEmpl%20Chart%20File.pdf">Private sector jobs</a>&nbsp;increased by 2,400 over the month, while government increased by 800.

Since October 2022&nbsp;Kansas'&nbsp;<a href="https://klic.dol.ks.gov/admin/gsipub/htmlarea/Uploads/Press%20Release/LR%20Oct2023%20Seasonally%20Adj%20PR%20Packet.pdf">seasonally adjusted total nonfarm jobs</a>&nbsp;have increased by 15,600. This change is due to an increase of 8,300 private sector jobs and an increase of 7,300 government jobs.

October unemployment up in Reno County

MAIZE, Kan. — Maize USD 266 is <a href="https://www2.ed.gov/about/offices/list/ocr/sharedancestry-list.html">being investigated by the U.S. Department of Education's Office for Civil Rights</a>.&nbsp;

The school district said in an email to parents Thursday night, "A copy of the complaint was not provided to Maize USD 266 by the U.S. Department of Education Office for Civil Rights, so we are unable to make any further comment regarding this matter.&nbsp;

"Maize USD 266 takes allegations of discrimination seriously and is committed to cooperating fully with any investigation. The school district is dedicated to providing a place for teaching and learning that prioritizes and champions respect and inclusivity and where all students and employees feel safe and valued."

Five of the complaints nationally allege antisemitic harassment and two allege anti-Muslim harassment. No word has been given on the specific grounds for the USD 266 complaint.

Maize USD 266 under federal investigation

HUTCHINSON, Kan. — The Salvation Army's Red Kettle kick off was Thursday at noon in front of the Toy Depot on south Main.&nbsp; The red kettle campaign collects funds that go toward food, shelter and ongoing expenses for families. The funds raised go directly to local communities.&nbsp;&nbsp; 

Three downtown businesses are hosting kettles for another year. Mark Buckley of Toy Depot, Kevin Rule of the Sleep Shoppe and Furniture Gallery and Chris Barnes of Smith's Market have a red kettle outside each of their stores.&nbsp;&nbsp;

Buckley said that this is Toy Depot's fifth year to have a kettle at the business. He said the Salvation Army has a special place in his heart.

"It brings a beautiful sound to the neighborhood and it makes the neighborhood warm and it helps bring people," Buckley said. "So it's all about helping. It really is. And that's what Kevin and I are about and Chris. We all decided how can we help."&nbsp;

&nbsp;Buckley said the goal this year is to raise $5,000 between the three businesses. After the bells are rung by volunteers, cash or coins can be dropped into the red kettles.&nbsp;&nbsp; 

The kettles can be filled until Dec. 23. Go to&nbsp;<a href="https://www.registertoring.com/" target="_blank">registertoring.com</a>&nbsp;to volunteer as a bell ringer. Those who register in Hutchinson, will be put into a drawing for Kansas City Chiefs tickets.&nbsp; &nbsp;

SOUTH HUTCHINSON, Kan. — The Reno County Planning Commission spent another two hours on Thursday hashing out further edits to the proposed commercial solar regulations in the county after hearing public input on Nov. 9.

The final version of the new section is not yet ready as there were still a couple of issues the planning commission wanted to do more research on, so the Planning Commission recessed the case until their next regular meeting, which will be Thursday, Dec. 21 at 4:30 p.m. at 600 Scott Boulevard in South Hutchinson.

Currently, there is a moratorium on commercial solar development in the county in effect through December that was put into place earlier this year by the Board of County Commissioners.&nbsp;

If a final draft were able to be reached and approved at the Dec. 21 meeting, the Board of County Commissioners could theoretically take it up at their meeting on Dec. 27 without having to extend the moratorium.

Planning Commission continues work on solar regs

HUTCHINSON, Kan. — The Boys and Girls Club of Hutchinson Youth of the Year candidates will speak to the Hutchinson Rotary Club on Monday, Nov. 20 at noon at&nbsp; Stringer Fine Arts Center on the campus of Hutchinson Community College.

TAYSHA RIDEAUX: Taysha is a junior at Hutchinson High School and has been a Club member for 10 years. Taysha is active in Student Council, Fellowship of Christian Athletes, and athletic training at school. Taysha says she wants to impact youth by “showing them that no matter what life has brought to you, that you can still be yourself and that you will be more than what others think of you.”

CAMRYNN HARRIS: Camrynn is a sophomore at Hutchinson High School and has been a Club member for 11 years. Camrynn is active in Fellowship of Christian Athletes, football, basketball, and track at school. The impact Camrynn wants to make is by setting an example “that you can reach high potential and complete high goals no matter what you are going through.”

ZION BURGESS: Zion is a senior at Hutchinson High School and has been a Club member for 6 years. Zion is active in Fellowship of Christian Athletes, Keystone Club, and football at school. Zion says he wants to be the voice of bringing all people together, “this world has fallen apart because of many different beliefs, but I believe that growth can be in process once change happens and once people find happiness in growing together.”

Bethany College receives $500,000 gift

HUTCHINSON, Kan. — Hutchinson High School students in the Rise Up Reno prevention network Kara Cape, Jaycie Rutherford, and Hailey Cape and Reno County Health Department Educators Tonya Culp and Thomas Simmons shared information with people about the Great American Smokeout and gave out free hot chocolate during Third Thursday Nov. 16. 

Information was handed out about KanQuit and other smoking cessation programs so people who want to quit smoking or know someone who would like to quit could learn about the programs available to them. They could sign a pledge card telling people what they would do instead of smoking. 

Some pledges were "I'll go for a walk when I feel like vaping, I'll talk to my Aunt about KanQuit, and I'll eat healthy when I feel like smoking." 

The Great American Smokeout is a national event held every third Thursday annually in November, sponsored by the American Cancer Society. TECH Gala Auction Preview Friday

HUTCHINSON, Kan. —  Bretz Injury Law is excited to present the 2023 Ride Like MADD Poker Run happening in Wichita, KS on Saturday, Nov. 18.

"Mothers Against Drunk Driving is a fantastic cause that we're honored to be a part of," said Stephen Brubaker with the firm. "Matt Bretz serves as the Vice Chair on the national board of directors for MADD. Through his 30 years of serving those who have been injured, we've seen a thing or two when it comes to drunk driving accidents. We hold this close to our heart."

The Poker Run this year is in honor of Sedgwick County Deputy Sidnee Carter.

"She was responding to an accident last October when an impaired driver pulled out in front of her and, unfortunately,&nbsp; ended her life," Brubaker said. "We decided that it would be fitting to honor her."

The entry fee is $25/hand and $10 for each additional hand with donations also being accepted. All vehicles are welcome to participate.

Prizes will be awarded to the winning hand, the second best hand, and the worst hand. The winning hand will receive 25%, the second best hand will receive 15%, and the worst hand will receive 10%. The remaining 50% will be donated to MADD (Mother’s Against Drunk Driving) of Kansas.

"It's about an hour of riding, about 50 miles," Brubaker said. "It's a good opportunity to get your bike out and have some fun."

The event starts Saturday at Bikers Edge Powersports, 1201 E Central in Wichita. Registration will begin at 9:30 a.m. with engines starting at 10:30 a.m. Stops include Cycle Gear, Jay Hatfield Honda Powerhouse, Savage Cycles, Freedom Road Cycles, and Twister City Harley-Davidson. 

A free lunch will be served after the run courtesy of Twister City and the PrairieThunder HOG Chapter. There will be a $5 raffle and plenty of door prizes at lunch. Donations for MADD are also accepted.

Ride Like MADD Poker Run is Saturday

HUTCHINSON, Kan. —&nbsp;The 2023 Project Concern donations close on Monday at the Eagle Media Center in Hutchinson. Donations this year are behind last year's pace, and the need this year continues, along with the rise in prices, according to Maj. Paul James with the Salvation Army.

"We need, probably $20,000 just to do last year," James said. "We had to buy additional gift cards last year for that. Our goal is to make sure people are taken care of the best that we can. We encourage more giving, for sure."

Signups are outpacing last year, at this point.

"With both Thanksgiving and Christmas signups, we're almost to the 1000 kids that we had last year," James said Thursday. "We have until Dec. 5 for Christmas. Today is the last day for Thanksgiving sign up."

The last in person opportunity wraps up at noon Thursday, but you can still log on to&nbsp;<a href="https://saangeltree.org/">https://saangeltree.org/</a>&nbsp;for Christmas purposes.

"You could be helping your neighbor," James said. "As the numbers go up, you likely are helping your neighbor. Last year, fortunately, our Christmas distribution is a little bit later than some of the other communities where the Salvation Army is at and they had some leftover toys, so we went to three other communities, just to even make that happen last year."

Project Concern donations needed

MUNICH,&nbsp;Germany — As part of a <a href="https://redirect-yp.siemens-energy.com/redir/dvghjpqruyobctslo7mw3vgoi57wva2jf3iwdtzlr6ktvjvsi6ga/Fwk9RM1ZlWyT0gnZD8Eq8PPJ7H9mRbnDa8qN6rLKILI">press release on Wednesday</a> to end Siemens Energy's fiscal year, the company noted that Siemens Gamesa's struggles earlier in 2023 have caused overall issues for the company.

"The wind business remains a major challenge and has led to the net loss in 2023," the release said. "In the past financial year, Siemens Gamesa suffered an unexpected, serious setback. Charges for quality issues in the onshore business, increased product costs and ramp-up challenges in the offshore business severely impacted the results for the fiscal year 2023 and will continue to impact the Group's profitability in the near to mid-term. Break-even at Siemens Gamesa is now expected in fiscal year 2026.

"However, the wind subsidiary is also making progress. The technical analysis of the quality issues for the onshore platforms 4.X and 5.X is almost complete and the results so far confirm what was communicated in August 2023. No further provisions in these fields have been made since the Q3 announcement. Remedial actions have been defined and mitigation and corrective actions are under development. Siemens Gamesa has still suspended the commercial activities on the 5.X platform and is defining a timeline and approach to set out how and when to resume sales with a design incorporating the respective corrective measures.

"In the offshore sector, Siemens Gamesa is focusing on ramping up its factories and new product generation as well as executing its order backlog. Output has been significantly increased compared to the fiscal year 2022. To help achieve the turnaround, and return Siemens Gamesa to profitability, the scope of Siemens Gamesa’s activities is currently reviewed."

More details will be revealed on Capital Market Day on November 21.

The loss before special items is around $3 million.

RENO COUNTY, Kan. — A Reno County horse farm and rescue dedicated to saving abused and mistreated animals is in need of help after one of their most crucial pieces of equipment broke down.

Gofundme underway to help horse rescue

Today's "Throwback Thursday Collection" takes us to the northeast corner of North Pershing Street and East Fourth Avenue. 

The J.S. Dillon and Sons Grocery Stores were created right after World War I by Ray and Clyde Dillon. They flourished quickly and spread to many outlets. About 1932, they constructed store #10 at 800 E. 4th. The first photo shows that location in 1940.

The second photo not only shows that Dillons store, but also the Bob-O-Leah Dairy next door at 804 E. 4th in 1941. That business was there between 1941-1947.

In 1955, Dillons closed this store to build a bigger, newer store just west at 734 E. 4th, which opened in 1956. In the 1960s, this building was Trend Stores Inc. Shoes. 

In the 1970s, the store was Austin's Inc. Shoes. 

In the 1980s, it had become a bingo hall. About 1990, Don and Janice Frye opened Mom's Attic, antiques, books and records in this location. The third photo shows that business.

In 2018, Steve and Shirley Fiffe purchased the property and created The Warehouse on 4th, antiques and stuff. The fourth photo shows the property at 800 E. 4th today, still The Warehouse on 4th, with the property owned by Fiffe Enterprises L.L.C.

 </figure>In 1955, Dillons closed this store to build a bigger, newer store just west at 734 E. 4th, which opened in 1956. In the 1960s, this building was Trend Stores Inc. Shoes. In the 1970s, the store was Austin's Inc. Shoes. In the 1980s, it had become a bingo hall. About 1990, Don and Janice Frye opened Mom's Attic, antiques, books and records in this location. HUTCHINSON, Kan. — Hutchinson Wesleyan Church will host a free "Friendsgiving" tonight in Creekside Neighborhood from 6:30-8 p.m.&nbsp; This is Hutchinson Wesleyan's fourth year hosting the Thanksgiving event.&nbsp;

Pastor Nick Huck of Hutchinson Wesleyan said a basic Thanksgiving meal including turkey, mashed potatoes, stuffing, vegetables and pie will be served.&nbsp;&nbsp;

"Last year we had 110 people that we fed and it's just a time for people to come together that maybe they don't have family or anybody to do Thanksgiving with," Huck said. "It's kind of just a you know come together with friends."

Huck said when the Hutch Rec started working with Creekside, community members brought up the idea to host a Friendsgiving in the neighborhood. Neighborhood Development Coordinator Adam Stewart of Hutch Rec helped coordinate the event.&nbsp;

"As we were having our meetings with Adam and talking about it [and] thought they might want to do and we said hey we are willing to host it and provide the meal and everything," Huck said.&nbsp;

Several neighborhood members of Creekside help serve the meal. Huck said community members are welcome to bring a dessert but food donations are provided by the church.&nbsp;

&nbsp;"It's just our ministry to the community," Huck said.&nbsp;

Hutchinson Wesleyan Church is located at 10th Ave. and Jackson.&nbsp;

Creekside Neighborhood to host free Friendsgiving meal

HUTCHINSON, Kan. — NAACP Hutchinson and SW Bricktown Neighborhood would like to invite the public to an open forum with the new Hutchinson Chief of Police and Officers from HPD.

Chief Brice Burlie will have a chance to introduce himself and take questions from the public for the Hutchinson Police Department.

The forum is Thursday, Nov. 16 at 6:30 p.m. at the Shears Technology Center on the campus of Hutchinson Community College.

Reminder: New police chief at public forum

HAVEN, Kan. — Haven USD 312 Superintendent Craig Idacavage posted a letter on social media clarifying district policy on weather delays and cancelations on Wednesday.

"When inclement weather is predicted, preparation will begin as soon as possible by our facility and grounds crew," Idacavage said.&nbsp; "We assess the situation and weather predictions around USD 312. 

"During this time, I will communicate with my contacts to further assess the scope of the impact the weather has on our buses, roads, and other area schools. An announcement could be made the night before but is sometimes made in the morning hours before school. We will always try to make that decision as early as possible to help families make necessary plans. 

"The following steps will be taken once a decision has been made. If the decision is made to postpone the start of school or cancel school, the Superintendent will immediately notify parents/guardians and staff via a voice call. An email and text will go out to all staff and families. 

"After those initial notifications, we will follow our standard notification procedures (news media, social media, websites, etc.)"

The reason Idacavage clarified is to remind parents and guardians to have their contact information up to date. 

"Please contact your school office if you have not been receiving district emails so we can update your contact info," Idacavage said. 

If school is on time, at the normal time and in person, there will be no notifications. This is to reduce the confusion of adding additional messaging for parents, students, and staff to sort through when searching for the most updated postings. 

"We will alert you if school is canceled, we will not alert you when school is in session," Idacavage said.&nbsp; 

When school is canceled all campus activities (including community facility use) are canceled for that day and evening. If students have scheduled activities away from school, coaches and sponsors will communicate directly with their teams and activities.&nbsp; Delays in USD 312 do include the Little Learners preschool, as well. If there is a 2-hour delay, they will open at 9 a.m.&nbsp;

SOUTH HUTCHINSON, Kan. — After over an hour and a half of public input on Nov. 9, the Reno County Planning Commission will consider some edits to the solar regulations document before moving it along in the process.

The Commission closed the public hearing with just a single day of comments.

The board's regular meeting is at 4:30 p.m. at the Reno County Public Works office at 600 Scott Boulevard in South Hutchinson.&nbsp;

Right now, Reno County is still under a moratorium on commercial solar development put in place by the Board of County Commissioners through the end of the year.&nbsp;

Planning commission to discuss solar edits

RENO COUNTY, Kan. — The Reno County Board of Canvassers conducted the canvass for the Nov. 7 General City/School Election on Wed. Nov 15, 2023. 

Because of a tie vote for Langdon City Council between Lathan Keener and Karen Fisher, the canvassers will break the tie vote on Wed., Nov. 22 at the Reno County Commission meeting in the Veterans Room at the courthouse.
