LOUISVILLE, Ky. — The trial of an Indiana man accused in the wreck that killed Trey Jones and injured Amy and Ava Jones will begin next week.

Michael Hurley was on probation in Indiana for drug-related charges at the time of the crash, according to court documents detailing his criminal history.

He admitted to officers that he was doing drugs before the July 5, 2022 accident.

Hurley is accused of one count of murder, three counts of assault and one count of driving under the influence. If convicted, he could get up to 70 years in prison.&nbsp; 

Ava Jones remains on scholarship at the University of Iowa, though she&nbsp;<a href="https://hutchpost.com/posts/3b59ae88-485c-4271-a63b-4092b55dc260">announced earlier this spring that she is no longer going to attempt to return to basketball</a>.&nbsp;&nbsp;

HUTCHINSON, Kan. — The regularly scheduled Hutchinson Planning Commission meeting for Tuesday, October 8, 2024 has been cancelled due to a lack of agenda items.

TOPEKA — The Kansas Department of Agriculture and the Kansas Department of Health and Environment together advise Kansans to be alert to the human health risk caused by unvaccinated animals, following a second detection of rabies in a cat in the last two weeks, according to a media release from the Kansas Department of Agriculture.

The two cases were in Jewell County and Harvey County, and both involved outdoor cats which exposed multiple humans and other cats. The known human exposures have started rabies post-exposure prophylaxis, a series of five vaccinations to prevent rabies in humans.

Rabies is a viral disease transmitted by the bite or scratch from a rabid animal. There have been six positive cases of rabies in cats this year, as well as several cases in wildlife. Both of the cases this month were in unvaccinated outdoor barn cats.

“Rabies is not unusual in the wildlife population, and unfortunately this often means domestic animals that roam freely can be exposed to the virus,” said Animal Health Commissioner Justin Smith. “It is vital to vaccinate domestic animals against rabies, especially animals that interact with humans, because humans can be infected. Vaccinating pets and livestock against the virus protects both animal health and human health.”

Even if an animal is kept indoors, ensuring their vaccination against the virus is up-to-date serves as an important barrier if they are ever exposed to a wild or stray animal that could be carrying the disease. Those who have barn cats should have them vaccinated against rabies.

Many Kansas cities and counties have vaccination requirements; know what is required in your community and contact your veterinarian for more information about rabies vaccination.

Rabies attacks the brain and spinal cord and can take several weeks to months for symptoms to appear, but early treatment after an exposure can prevent rabies in both humans and pets that are up to date on vaccinations. The vaccination is highly effective.

If you notice unusual behavior in your animal, or you think your animal may have had contact with rabid wildlife, it is important to immediately contact your veterinarian to determine the next steps to take.

If you are a veterinarian, remember to always consider rabies as a potential diagnosis for neurologic animals.&nbsp;In Kansas, rabies is&nbsp;a reportable disease which requires a veterinarian to report a positive rabies test&nbsp;to the KDA Division of Animal Health.

In order to prevent the spread of rabies, people should teach children to be cautious around outdoor animals, wild or domestic, even if they look to be friendly; wash a wound from an animal encounter thoroughly with soap and water and get medical attention immediately; keep pet vaccinations current; and monitor pets when outside.

Today's "Throwback Thursday Collection" takes us to the northwest corner of East 17th and North Plum.

In the mid-1970s, Floyd Dick and Robert Owens formed the Patlyn Oil Co. and started acquiring gas stations.

In 1978, they purchased the old Herman Oil Co. gas station at 434 E. 17th.

In 1984, Robert Owens solely owned the company and had bigger ideas. The first photo shows the Robert Owens Gas Station in 1987 right before demolition.

Owens idea was to get into the convenience store/gas station/car wash business. The second photo shows his "full stop" dream under construction.

Owens then leased the completed property to the Wen's One convenience store group, owned by the Wenger Oil Co. out of Newton. The third photo shows the property during the Wen's One occupation.

In 1998, Owens converted the lease over to the T &amp; E Oil Co., owned by the Shorty Brown Family. They converted the property into the "Pantry Plus" convenience store moniker. The fourth photo shows the property then, under that name.

In 2003, the Pantry Plus group sold out to the Kwik Shop group, who just happened to own a facility just diagonal in the intersection. That's when the 434 E. 17th property was rebranded to the Kwik Shop. The fifth photo shows the property today, still the Kwik Shop, with the property still owned by the Patricia and Carl Owen Trust of Oklahoma City.

HUTCHINSON, Kan. — Jim Gruver with the Downtown Hutch Rod Run is looking forward to the 17th annual event Friday and Saturday. Registration on Friday begins at noon.

"Everybody comes in a little different this year," Gruver said.&nbsp; "We are not pre reserving any parking spots so a couple of options. People can come in go where they want to park walk back to the registration and register or they can just get in line at registration."

More than half of the cars are there both days, though Saturday is the larger day and had almost 300 cars last year.

"The big thing on Friday is 6:00 p.m. is our annual cruise," Gruver said. "Everybody takes out leaves the event and a lot of them just drag up and down Main. A lot of them just go different places in town. It's kind of open to whatever they want to do. We have a little cruise route up and down Main, that back in the day used to be Sandy's a restaurant down there on North Main and that's kind of the turnaround spot and coming back, but the other thing that goes along with that this year is we are doing a poker run which will go to five different locations.&nbsp; Anybody that comes to the and signs up at the rod run that day can be registered and join the the poker run also, and there's a $500 cash prize for that poker run."

The parking spots do not hold from one day to the next, so registration at 8 a.m. Saturday will be important for those that want the best spot on the busiest day, and there will be plenty of trophies given away Saturday, as well.&nbsp;&nbsp;

"We've kind of slimmed it down a little bit now from what we used to," Gruver said. "I think we are at 26 different classes right now and each one of those classes then is divided up into different years, so number of trophies is I think 50 some different trophies."

HUTCHINSON, Kan. — Creighton University economist Ernie Goss notes that the manufacturing sector is showing some weakness in this part of the country.

"We've lost manufacturing jobs for 2024," Goss said. "The U.S. economy has lost more than between 33 and 40,000 manufacturing jobs just in 2024. So manufacturing, we may not call it a recession, but it sure feels like a recession for certain portions of the manufacturing sector."

The Sunflower State is seeing its own struggles, specifically.

"In Kansas, you're talking about aircraft manufacturing and parts manufacturing, which is a big, big important industry for the state of Kansas," Goss said. "That's undergoing some significant changes. I look no further than Boeing aircraft to see what's going on there and the connections to the Kansas economy. That's certainly being felt by a lot across the region, but particularly in Kansas."

The supply managers and bankers that Goss surveys regularly are pretty negative about the coming months.

"There's a lot of pessimism out there in this part of the country," Goss said. "I think it's also in other parts of the nation, but particularly here because of the dependence on agriculture, the dependence on manufacturing, and now we've got this strike going on. Now, we'll have to wait and see."

Goss said the labor actions across the country, from Boeing in the northwest to the dockworkers in the Gulf and Atlantic, will have a drag on the economy in the fourth quarter.

Goss: Jobs lost in manufacturing in Midwest

HUTCHINSON, Kan. — The Hutchinson chapter of the NAACP has announced their keynote speaker for the upcoming Freedom Fund Dinner&nbsp;on Saturday, Oct. 19 at 7 p.m. at the Stringer Fine Arts Center at HutchCC.

The keynote speaker will be Victor Goode, Associate General Counsel from the NAACP's National Office.&nbsp;In addition to that role, Goode has also served as the Interim National Education Director.  A Thurgood Marshall School of Law graduate, his work at the NAACP has ranged from fair housing and equal education opportunity to voting rights and public accommodations discrimination, in addition to in-house counsel work. He served as Project Manager of the National NAACP Redistricting team and was co-counsel on the Texas and Florida statewide redistricting cases and on the Texas voter ID case. He was co-counsel in Shelby County, Alabama v. Holder in which the Supreme Court declared part of the Voting Rights Act unconstitutional. A recipient of the Medgar Evers Award, the national NAACP top staff award, Victor was architect and co-author of the NAACP Supreme Court amicus in Fisher v. UT, a challenge to the use of race as a factor in admission.

Some of his most satisfying work is the small victories, like getting a Louisiana district to reinstate a 9- year-old homeless girl whom district officials had wrongfully expelled.  Or assisting a Texas high school student in a Houston suburb to obtain Office for Civil Rights systemic relief against the district for racial harassment; the agreement applied to the entire district, not just her high school, and it also applies to harassment based on national origin, including language.

Victor has used the First Amendment and Equal Protection to successfully protect the Association's right to conduct third party direct mail voter registration campaigns, the right of an NAACP leader who worked for the government not to have to choose between his job and his volunteer work in the absence of a conflict, to obtain a Texas Education Agency ruling that Austin Public Schools squelched Austin NAACP speech, and to protect NAACP membership lists against litigants’ discovery.

While Victor spent a great deal of time on the Association’s Black Bike Week public accommodations discrimination cases in Myrtle Beach, South Carolina, e.g., NAACP, Inc. et al. v. PAAR Inc., d/b/a/ Damon’s Grill et al., No. 4:04-1691-RBH (D.S.C.-Florence 2006)(settled), he later focused on education cases, e.g., NAACP by its Omaha Branch et al. v. David Heineman, in his official capacity as Governor of the State of Nebraska, No. 8:8:06-CV-371 (D. The data revealed that the school district had not fully complied with the terms of the settlement, but the Court subsequently dismissed the case for lack of subject matter jurisdiction).  Alexander, et al. v. Underhill, et al., No. CV-N-05-00178-LRH(RJJ)(D. Nevada 2007) (Victor drafted an amicus curiae brief for the Reno NAACP in a challenge to the school district’s approach to student suspensions, claiming that the district violated procedural due process by failing to provide the students with meaningful notice and opportunity to be heard).  He continues to advise NAACP affiliates on how to work toward greater desegregation within, and between, school districts.  

As a staff attorney at Advocates for Basic Legal Equality in Toledo, Victor served as lead counsel in Almendares v. Palmer, a statewide class action to challenge County and State welfare department treatment of Food Stamp Program participants and applicants whose primary language is Spanish. The case settled, after a successful 4 year fight to obtain class certification.  He also used administrative complaints to obtain systemic relief in education and health care cases.  He worked with others to help convince the Toledo Public Schools to pass its first anti-racist, multicultural education policy. He worked with the Port Clinton Public Schools to re-evaluate its policies on student race and gender harassment and equal educational opportunity.  The superintendent and school board revised its policies &amp; sent teachers and administrators to trainings/in-service on diversity/dealing with racism.  Victor negotiated first time agreements with a school district to provide a Vietnamese translator for a student preparing for state proficiency exams and with County mental health providers to provide an interpreter to Vietnamese clients who needed this service.  

Pro bono work has been very important, e.g., as a lawyer for Texas State Conference NAACP he investigated funky water, suspicious deaths, racist housing, and the Klan, with co-counsel obtained injunction against Austin Public Schools in a high stakes testing case (about 80 seniors allowed to participate in graduation ceremonies in district high schools), architect of Toledo NAACP complaint to FCC against radio station that violated an FCC rule (FCC fined radio station $4000).  He and his wife, sociologist Dr. Jennifer Goode, conducted the first empirical research, creating their own customized databases, on Toledo's Safe School Ordinance. They presented their research at the Harvard Civil Right Project School to Prison Pipeline Conference and other national conferences.

HUTCHINSON, Kan. — According to a social media message from Central Christian School, Superintendent Dr. John Walker, serves as the state representative for all Kansas schools which are members of the Association of Christian Schools International (ACSI). 

He recently spent several days in Washington, D.C., at ACSI’s National Public Policy and Advocacy Summit to hear from and meet with some of the nation's top leaders regarding education policy, faith, and political issues. At the summit, Dr. Walker shared with other ACSI school leaders how he is involved at the state level, and he encouraged others to do the same in their home states.&nbsp;

Walker also met with Representative Tracey Mann and the congressional staff of Senator Roger Marshall and Senator Jerry Moran.

"As Christians, school leaders, and citizens, we must be engaged in the sphere of politics," Walker said. "Our culture is surely not sitting on the sidelines remaining neutral, and neither must we remain neutral on policies that will impact our children's children. What a blessing it is to live in the United States of America and to have the opportunity to interact with the political system to make our voices heard."&nbsp;

CCS Superintendent visits Washington D.C.

HUTCHINSON, Kan. — Buhler USD 313 Superintendent Cindy Couchman told Hutch Post the open houses on Tuesday for their new facilities went well, in her opinion.

"I didn't know what to expect," Couchman said.&nbsp; "I've never been a part of hosting an open house at different facilities. We had our three new construction facilities open. The Buhler Beginnings Daycare in Buhler, I think we had 17 people that walked through in our community to look at it, which for an hour and a half, and Buhler on a busy night, we had home volleyball, a lot of things going on. It was really nice to see everybody walk through. I think we had more than that at Crusader Corner Daycare. We probably had upwards towards 30 go through that facility, and maybe 10-ish go through our Ad Astra facility. It was just really nice to have people come and look at kind of the changes."

The new daycares are filling up, but they are not full yet.

"We did a slow, soft start opening, which I would encourage anyone who's opening a daycare to do that and not open full, that is sort of what we have done," Couchman said. "We've tried to add like five to 10 kids every week between the two of them. Our infant spots, I believe are kind of spoken for in full. We've been adding like two to three every week of the infants and like four to five to six of the toddlers. And we do still have openings in the toddler. I think our infants are getting close to being full and spoken for."

Balancing classes so that those infants can be promoted promptly while still filling the older classes is a challenge.

"The logistics on that's kind of interesting," Couchman said. "You know, the infants, you know, they age out into the toddler room as soon as they're walking and they can go to the toddler room. You know, those age out and go to the three-year-old program. As one infant comes out, you wanna make sure you have a space for them. There are different ways of doing that. We have a mixed room, which means that you can have both age groups in the room. Then we have just an infant-only room. And so, yeah, you should see the chart that we have, you know, different ages and it shows, you know, like when they would age out to the next room and what that cycle looks like. There's actually a program that does it for us, which is kind of nice."

Open houses held for new USD 313 facilities

HUTCHINSON, Kan. — According to a social media post Wednesday, the new trailhead for the Bad Bobby trail off of Plum Street is starting to improve.

With input from the family, sculptor Amos Robinson is creating a kinetic sculpture of Bad Bobby Helfrich doing what he loved the most. It will be mounted on a tall pole at the 39th and Plum trailhead. The wheels will spin with the wind. 

The trail is still open, but the lot is closed until the work is finished.

HUTCHINSON, Kan. — The Hutchinson Public Library is proud to announce the debut of a new online catalog system, VEGA Discover, aimed at creating a more streamlined, efficient experience for patrons.

With this new system, library patrons can now:

● Navigate the catalog on their phone, tablet, or computer

● Use Smart Searches, which have spell check, automated search suggestions, and the option to see related keywords to their search

● Check out and hold eBooks, audiobooks, and more, right from the catalog

● Choose to renew material automatically three days before it’s due

● Change their communication preferences to be contacted via email or text

This is all in addition to the existing features that library patrons can take advantage of, including the ability to enable reader history to let you keep track of what you’ve checked out in the past, keep existing holds (even if they’re frozen), and create reading lists. All of these changes make it easier than ever to save time and money while supporting your local library.

Replacing the catalog system is a significant financial investment and commitment of HPL staff to migrate library data and learn the new system. The investment reflects the library’s commitment to serving the community by making it as easy as possible to use the collection.

Rollups combine each format (book, large print, ebook, audiobook, and more) into one search result displaying each in a separate tab. "I think it'll probably come back at some point," said Mayor Greg Fast. "You know, again, I can share my personal opinion on that and that is thatI think that more people have access to the internet then they have access to the newspaper. I know there's value in holding a piece of paper in your hand and reading the news, but I mean less and less people are actually doing that. More and more folks have the ability to be online and I think that it would probably make sense in my mind for transparency, for community involvement, to have that online and furthermore, it would save the city quite a bit of money every year."

Fast didn't know when the issue would be brought back up again.

City council still mulling impact of making website official newspaper

HUTCHINSON, Kan. — The temporary traffic circles on Panorama Drive in Hutchinson are going away.

"We do intend to remove them tomorrow," City Manager Enrico Villegas said Tuesday. "We'll move forward with stop signs, locates have already been called in so all of that can just take place tomorrow."

Villegas said the issue was raised while they were already talking about the 43rd and Halstead issues in previous months.&nbsp;

"Some of them have come to council even before we started meeting with them," Villegas said. "They had shared with me that the city in the past had put white striping down on the roads and there was a traffic study that was done, but they've been complaining for over a year to try to get the city to do something."

As it turned out, because people were cutting across the wrong side of the traffic circles, it wasn't slowing traffic down as much as had been hoped.

"Our traffic consultants, our traffic engineers, they said that stop signs were not an advisable form of traffic calming," Villegas said. "You may not solve the problem by just putting in stop signs."

That is what they are going to try next, though and they will do that right away after the circles are removed.

NEWTON, Kan. — The Harvey County Planning and Zoning Advisory Board will meet Oct. 8 to review the County's comprehensive plan. 

The comprehensive plan is a guiding document used to aid decisions for determinations on land development, generally focused on the unincorporated areas of Harvey County. Comprehensive plans are intended to last several years.

The Oct. 8 meeting will be held at 7 p.m. at the Harvey County Courthouse. Citizens that attend the meeting can indicate if they would like to speak during the meeting as they sign in. The planning board may consider adoption of the comprehensive plan updates at the meeting.&nbsp;&nbsp;

HUTCHINSON, Kan. — After once again hearing from the owner of the Atrium Hotel, Joshua Joseph, the Hutchinson City Council unanimously voted to tear the building down at their meeting Tuesday afternoon. Ultimately, it was the testimony of Hutchinson Fire Chief Steven Beer and local resident Jackie Long that won the day.

"I think there's one thing we should have a quick discussion on here," said Hutchinson Fire Chief Steven Beer. "That is what we deal with day in and day out, the safety aspect of our workers in the city, my men and women, the police department's men and women that have to deal with this project, if we keep kicking it down the road. We are going to get somebody killed in this building. That's a fact, if we keep kicking this can down the road. We take enough risks the way it is, each and every day. My men and women respond on calls, but these are necessary risks that we have. With this building and stuff like that, it's just, there's no fence around it. It's going to get cold here towards the end of October. That's going to happen. There's going to be issues again with individuals taking up housing in that facility. I'm pleading with you. I say a prayer every night for my men and women on protecting their safety and I want you to consider that. Police officers and firefighters that have to go into these buildings to take care of these situations, that's a risk that we don't need."

Long's years of frustration living in that neighborhood came through in her comments, but she remained as cordial as possible, under the circumstances.

"I live at 1329 North Lorraine, across the street from the Atrium," Long said. "I want to remind you, the building is unsafe to be in. It's posted that way. There are people in and out of that building right now, taking, I guess, at the owner's permission, they are removing things. There are people that are living in the building. I have one question. Was Mr. Joseph owner of this property the last five years? Yes or no? Does an owner that cares about the property, or the city, treat the facility as they have, or do they protect their investment? The only protection that has been done has been by our city maintenance people and at the urging and the request of the city, not voluntarily, none of it."

She simply urged the council to do something and they have. Matt Williams with the city explained what will happen next.

"Due to the lack of progress on the repair or demolition of the structure and the lack of the required cash bond, the city will be moving forward with the demolition of the structure," Williams said. "A formal report of the bids and the award of the bid will take place in the coming weeks."

It's not clear until the bids are dealt with exactly how fast it can come down.

City council unanimously approves Atrium demolition

HUTCHINSON, Kan. — U.S. Representative Tracey Mann (KS-01) took to the floor of the U.S. House of Representatives for the final time before the 2024 presidential election to urge the nation to reject four more years of the Biden-Harris Administration’s policies. Below is the transcript of his comments.

Mr. Speaker, I rise to acknowledge that this will be the very last time I speak in this Chamber before we have a new president-elect. In the coming weeks, the American people will head to the polls, and we’ll have a choice before us. We can choose four more years of Vice President Harris’ chaos and madness, or we can choose four years of law and order and American strength. 

When I came to Congress almost four years ago, America was strong. Our streets were safe, and our border was more secure than any other point in recent history. Prior to the pandemic, the U.S. had one of the strongest economies we’ve had in the past 20 years. Even in the face of adversity, President Trump led the federal government in empowering America’s small businesses and families. Just a few years before, House Republicans passed the Tax Cuts and Jobs Act that put more money in the pockets of American families, put more food on their tables, and better positioned them to care for each other.

Four years ago, America’s strength was well understood on the world stage. The Trump Administration spearheaded the historic Abraham Accords, and the U.S. was tough on our adversaries like Communist China, Iran, and their terrorist proxies. We saw an era of historic trade deals with the passage of USMCA, President Trump’s trade deal with Japan, and his Administration’s work to hold China accountable for the deals it agreed to. It truly was an era of American greatness.

Unfortunately, much of that greatness has been undermined. I once looked at the nation and felt optimistic about the future that awaited my children. I felt that when it was time for them to spread their wings and build their own lives, they’d inherit a country that gave them the opportunity to pursue their American dreams. I was confident that when the time came for them to purchase a home, choose a college or university, or start their own small business, they’d step into an economy that empowered them to successfully do these things. On January 21, 2021, that started to change. Vice President Harris and President Biden have made America less safe, destroyed the American economy, and have made America look weak on the world stage.

Since day one, Vice President Harris and President Biden have been laser focused on rolling back President Trump’s policies that actually worked. Their open border policies have ushered 16 million illegal immigrants into the country without adequate background checks or vetting, making every state a border state. Rather than fixing their open border policies, they coddle radical activists and leave Americans at risk. Under their leadership, cartels and drug lords have been the winners, and the American people have been the losers.

Vice President Harris and President Biden’s economic policies are the sole reason for the skyrocketing inflation that has haunted America over the past three years. In the Big First District of Kansas, American families, small business owners, farmers, ranchers, and agricultural producers have struggled to manage sky high interest rates, higher input costs, and a crumbling economy. For young Americans, homeownership feels like a distant dream. Rather than reversing bad policy or coming up with solutions to these challenges, the Biden-Harris Administration’s proposal is more reckless government spending that got us here in the first place.

Vice President Harris and President Biden have failed to capitalize on the strength of President Trump’s trade deals and have formed ZERO new trade deals in the last four years. The country is facing the largest agricultural trade deficit that we’ve faced in years, hurting America’s farmers, ranchers, and agricultural producers who desperately want access to new markets to help feed a hungry world.

Vice President Harris and President Biden’s weak foreign policy gave Russia a green light to attack Ukraine while their appeasement to the Iranian regime emboldened Iran-backed Hamas to attack our strongest ally in the Middle East, Israel. As antisemitism rotted our own nation, college campuses, and universities, the Biden-Harris Administration turned a blind eye and instead held up congressionally approved arms for Israel to protect itself.

Mr. Speaker, —is this the future we want? Do we want to gift our children a nation with wide open borders? Do we want them to grow up in a country with an economy that fails to work for the average family and fails to address our $35 trillion debt? Do we want a nation that is unsafe or where the American dream is no longer attainable?

In a short few weeks, we will all head to the polls, and we have a choice. We can vote for a candidate who has told us what she wants to do to address her failing policies, or we can vote for the candidate who has shown us what his policies can do to strengthen the nation. I know what choice I will make.

Mann speaks on House floor about November presidential choice

The National Weather Service has implemented some changes to the cold weather products that they issue. These changes are effective as of today, October 1, 2024.

The products that used to be issued were called the Wind Chill Watch, Wind Chill Warning, and the Wind Chill Advisory.

These products have been changed into the Extreme Cold Watch, Extreme Cold Warning, and the Cold Weather Advisory. Along with these changes, the criteria for issuing these products has changed slightly.The main reason for these changes is to have better consistency across the US in relation to climatology of cold weather. These products remove any wind speed requirement and are issued when the actual temperature and/or wind chill temperature reaches these thresholds. Regardless of the wind speed, cold is cold!&nbsp; Extremely cold air comes every winter into at least part of the country and affects millions of people across the United States. The arctic air can be dangerous. Combined with brisk winds, dangerously cold wind chill values can result. People exposed to extreme cold are susceptible to<a href="https://www.weather.gov/safety/cold-during">&nbsp;frostbite</a>&nbsp;and can succumb to hypothermia in a matter of minutes. Areas most prone to frostbite are uncovered skin and the extremities, such as hands and feet.&nbsp;<a href="https://www.weather.gov/safety/cold-during">Hypothermia</a>&nbsp;occurs when the body loses heat faster than it can produce it.&nbsp;&nbsp;
