HAVEN, Kan. — The Haven School Board approved a new contract with its teachers and administrative staff during Monday's agenda session. The new contract raises the base pay for teachers in the district to $40,473 per year, an increase of 2.75%. Administrative staff and directors salaries also increased by the same 2.75%.

Also Monday night, the board approved the back to school plans for dealing with the pandemic. Under the plan, face coverings are recommended for students and staff with the final decision to be made by families and employees. All persons will be required to wear a mask when traveling in school vehicles including all bus routes, activities, field trips, and any vehicles transporting students and staff.&nbsp;

All high touch areas will be cleaned daily including gymnasiums, weight rooms, locker rooms and all desks and chairs in classrooms. The district says they will continue to coordinate and communicate with the Kansas State Department of Education, Kansas Association of School Boards, and the Reno County Health Department to stay informed with the updates from The Kansas Department of Health and Environment and the CDC.

THE HIGHLANDS, Kan.&nbsp; — One person was injured in an accident involving a golf cart over the weekend. Reno County EMS and the sheriff’s department were dispatched to 10000 W. Snokomo Road around 12:30 Saturday morning.&nbsp;

According to reports 18-year-old Preston Gover, of The Highlands and two passengers, 18-year-old Kolton Sims, and 18-year-old William Yates, both of Hutchinson, were in the golf cart when Yates fell off the cart and struck his head on the pavement.&nbsp;

Yates was transported by EMS to Hutchinson Regional Medical Center. Sims was cited for underage drinking while Grover was arrested for DUI.&nbsp;

One injured in golf cart accident

HUTCHINSON, Kan. — Higher car loads across the board helped BNSF to a solid second quarter. The nation's second largest railroad released its 2Q&nbsp; earnings report Tuesday.

BNSF reported a total revenue increase of 26% over the previous year at $5.8 billion. Operating income jumped 28% to $2.2 billion.

BNSF saw increases in every car load sector including coal which jumped by 32% to 384,000 loads. Total car load volume was 2.6 million loads, an increase of 24%.

Expenses for the railroad did increase by 25% as consumer goods began moving again as the first wave of the pandemic eased. Higher car volumes along with higher fuel prices were reasons for the increase. Fuel prices jumped 112% in the past three months.

BNSF operates about 10 trains per day through Reno County along with Amtrak's Southwest Chief. It’s the second highest property tax payer in the county at $1.7 million.

The case count for COVID-19 continues upward in Reno County. The number of cases as of Monday afternoon is at 172, up from 131 on Friday and 92 on the previous Monday. 

The last time the county had this many cases was in the week immediately following Valentine's Day.

The Hutchinson Regional Medical Center has seven COVID patients currently out of 64 total patients. Three ventilators are in use and 12 total patients are in critical care for all purposes.

Hospital staff intend to speak to the Board of County Commissioners at their meeting Tuesday morning about the situation.

Case count back to February levels at 172 as of Monday

HUTCHINSON, Kan. — Tyson Foods released its third quarter earnings report before the bell Monday.

The meat and poultry company reported earnings of just over $2 billion compared with $1.4 billion a year ago. Total sales also increased to $12.4 billion.

After some downturns due to the pandemic, prepared food sales increased by 4.5% to $2.3 billion and operating income increased by 6.5% to $150 million. Production and revenue is still down for the first nine months of the year due to restaurant shutdowns.

The company showed a strong recovery from the pandemic. Whether the company can sustain the run through the second wave of illness remains to be seen. The company was forced to shut down facilities during the pandemic in 2020 and has taken steps to try to avoid any repeat.&nbsp;

The company reported last week that all employees must be vaccinated by the end of November.

SOUTH HUTCHINSON, Kan. — After some back and forth over responsibility and ownership of the small bridge, the South Hutchinson City Council will hold a special meeting to take action on getting the Scott Boulevard bridge repaired or replaced.&nbsp;

If approved, the city and Reno County will enter into an agreement with the county to assist in any way possible, outside of any financial assistance. That could include any engineering and project management.

The two sides had been in disagreement for some time about who owns the bridge after the state dropped the weight limit too low for Reno County Public Works trucks to use. After some meetings, it looks like the city will take on the project with the county’s help. That meeting is set for Tuesday at 6 p.m. at the South Hutchinson city offices.

South Hutchinson council to discuss bridge agreement 

RICE COUNTY— It took a coin flip to decide the second participant in the November election for a City of Sterling council seat. 

According to County Clerk Aurelia Garcia, after the canvass of the August 3 election that took place Monday, there was a tie between Jeremy Bennett and Heidi McCullers. 

The Board of Canvassers decided to do the coin toss after certifying the Election results due to the fact that the Candidates were present.  

The winner of the coin toss was Heidi McCullers. McCullers will face Stephen Wilson in November.

Coin flip decides Sterling council primary

RICE COUNTY—One person was injured in an accident just after 7:30 a.m. Monday in Rice County.

The Kansas Highway Patrol reported a 2021 Chevy Express Van driven by 42-year-old Raymond P. Jones of Greensboro, North Carolina was northbound&nbsp;on 22nd Road at U.S. 56 when Jones stopped for the stop sign at U.S. 56, but did not see a westbound 2016 Ford F250 driven by 37-year-old Jose G.&nbsp;Hernandez Pantoja of Yoakum, Texas due to the sun in his eyes. The van pulled out in front of the pickup.

EMS transported Jones to the hospital in Lyons.

Hernandez Pantoja and a passenger in the pickup were not injured. All three were properly restrained at the time of the accident, according to the KHP.

Chamber taking nominations for Farm Focus week

HUTCHINSON, Kan. — One of two Hutchinson men charged with holding up two convenience stores in January will be in Reno County District Court for a preliminary hearing Tuesday.

Twenty-year-old Kevon Ford faces two counts of aggravated robbery. He also has a drug case and a theft case pending that will also be addressed on Tuesday.

Ford and 21-year-old Trever McDade are accused of the armed hold ups of the 17th and Monroe and the 43rd and Plum Kwik Shop stores. In both cases an armed man using an ice scraper or a hand saw as weapons made off with either money or tobacco products or both.&nbsp;

The two were arrested when officers arrived in the area of 43rd and Plum and located both subjects in a vehicle that had been reported stolen earlier that morning.

Preliminary hearing set in armed robbery case

As part of Hospice and Homecare of Reno County's Festival of Remembrance, they are back to doing a car giveaway. 

Mel Hambleton Ford has donated a 2018 Ford Escape to be raffled off.

"It's an awfully cute little college car or for your kids," said board member Mary Beth Reimer. "It's an online raffle. You can purchase tickets on the website. One ticket for $25, six for $100 or 15 tickets for $200."

"One of our local physicians, Patrick Clark, is putting the car in different locations throughout this week and next week," said Andrea Siefkes with Hospice and Homecare of Reno County. Reno County Health Department Director Karla Nichols is still calling on those who have not been vaccinated yet to do it.

"We do not have any large pods at this point like we were having in January, February and March timeframe," Nichols said. "The demand for the vaccine has gone down. It is truly an issue of supply and demand. We really do want the demand to come from the public and to come get the vaccine."

Even though KDHE has somewhat changed their guidance in recent days, Nichols notes that the guiding principles behind what they are going to bring to County Commissioners remain the same.

"We go back to our three foundation key points, which are vaccinations, testing and precautions," Nichols said. 

The Board of County Commissioners will have a chance to weigh in publicly as they meet Tuesday at 9 a.m.

"The demand for the vaccine has gone down. It is truly an issue of supply and demand. We really do want the demand to come from the public and to come get the vaccine."Even though KDHE has somewhat changed their guidance in recent days, Nichols notes that the guiding principles behind what they are going to bring to County Commissioners remain the same."We go back to our three foundation key points, which are vaccinations, testing and precautions," Nichols said. The Board of County Commissioners will have a chance to weigh in publicly as they meet Tuesday at 9 a.m.

The National Weather Service office in Wichita has issued a Heat Advisory from Noon today to 8 p.m. Tuesday. Heat index values of 103 to 108 degrees are expected in&nbsp;Central and south-central Kansas.

The House Committee on Redistricting and the Senate Committee on Redistricting will jointly hold a listening tour stop in Hutchinson from 9 a.m. to 10:15 a.m. Wednesday, August 11th at HutchCC's Stringer Fine Arts Center.

Testimony for the Hutchinson hearing needs to be provided to redistricting@klrd.ks.gov by August 10 at 5 p.m. A sign-up sheet will also be available the day of the meeting for persons who do not register by the deadline.

A long-time legal precedent regarding vaccinations could be challenged at the U.S. Supreme Court. A KU professor notes that Jacobson v. Massachusetts has been around for more than 100 years.

"The state of Massachusetts required that every adult be vaccinated against smallpox, on the pain of criminal sanction, you would go to jail," said KU Law professor Lumen "Lou" Mulligan. "The state of Massachusetts made no exception for a religious exemption or underlying medical condition. They just said, everybody has to be vaccinated, full stop. Mr. Jacobson protested. He claimed he had the Constitutional right to be free from a forced vaccination and the U.S. Supreme Court really had no problem saying, no, you don't."

Jacobson established a floor of constitutional protection that consists of 4 overlapping standards: necessity, reasonable means, proportionality, and harm avoidance. There are also First Amendment challenges on religious grounds that likely would have merit if a state decided to be overly draconian with the issue.

"There's no state or municipal government today, that I know of, that is pushing any kind of vaccine mandate that does not have some sort of religious exemption," Mulligan said. "For sincere religious beliefs, I don't take any vaccines at all, usually gets you an exemption, often coupled with things like the University of Indiana did, okay, you can do that, you have to be masked, you have to test, that sort of thing."

The states are given the police power and courts have traditionally given a lot of latitude to legislative bodies to make policy in this area, so it is important to remain engaged with all levels of elected officials as the COVID-19 situation continues to unfold.

KU Prof: Precedent in play in COVID challenge more than a century old

"There's not only going to be a fair, but it's going to be the biggest and best fair we've ever had," Berger said. "We're so excited about it. There's so much enthusiasm, so many advance ticket sales going on. People can hardly wait to be a part of the fair again. Losing a year in 2020 makes 2021 a huge year for us. We're very excited about it and so are our patrons, our vendors, exhibitors, everybody is anxious to have the Kansas State Fair."

It seems as if people are really going out to events in force that they may only have attended once in awhile before, the hope is that the Fair can build on that momentum.

"Sometimes you really don't value something until you don't have it," Berger said. "I think that's the case with the Kansas State Fair. We didn't have it last year. People just felt like they lost something in their lives, part of what they were and part of what the community is. That's part and parcel of, I think, some of the excitement surrounding the Kansas State Fair."

The fair does plan to take additional COVID-19 precautions in its buildings.

"What we're planning now is to be in cooperation with the Kansas Department of Health," Berger said. "We will recommend masking in the inside venues, Meadowlark, Sunflower, all of those buildings. We're also going to have one-way traffic in those buildings. We think that's going to be a help, as well. Outdoors, we're going to make masking optional. If people feel comfortable masking, we certainly will advise it, but, again, so much of our fair is outside and we think that is a very big advantage for us."

2021 Kansas State Fair is on, 'huge year' in store

HUTCHINSON, Kan. — The vice president of student services at Hutchinson Community College is leaving for another job. Dr. Brett Bright has accepted a position with Southeast Community College in Beatrice, Nebraska.&nbsp;

Bright will become the new vice president of program development, Beatrice campus director and athletic administrator for SCC. He replaces Bob Morgan, who retired. Bright was with Hutchinson Community College for six years.

He begins his new duties in Beatrice Sept. 1.

HutchCC's Brett Bright leaving for job in Nebraska

HAVEN, Kan. — The Haven school board will take action on a new contract agreement with its teachers on Monday.

The teachers voted on the contract after the district and the teachers union approved the agreement following a negotiation session in July.

Under the proposed agreement, teachers will see a 2.75% increase in pay. That will raise the starting base pay to $40,473 per year. The union was asking for a 3% increase while the board had countered with 2.5%.

Also Monday, the board will look over a list of capital improvements for next year and go over the back-to-school plan for dealing with the pandemic.

An executive session is also on the agenda to talk over a personnel matter, and the board will take action on contracts and work agreements within the district.

Monday's meeting of the Haven school board begins at 6 p.m. at the Haven District Offices at 414 W. Main.

Haven school board meets Monday

HUTCHINSON, Kan. — A motion hearing for a Hutchinson man sentenced to at least 48 years in prison on a first-degree murder charge was continued Friday in Reno County Court after the defense attorney for Charles Logsdon failed to show up. Logsdon has filed a civil motion citing ineffective counsel.

Logsdon was convicted of intentional first-degree murder in the shooting death of Jennifer Heckel in 2011 in her home. The shooting was a case of mistaken identity.

In his civil case, Logsdon claims that the defense failed to call 15 witnesses that could prove his innocence. The list includes cellmates, people he claims were with him the night of the murder, and a neighbor of Heckel who says she saw a white male in the victim's backyard a week before the murder.&nbsp;

Motions were to be heard in the case, but attorney Sam Kepfield did not appear. The hearing is now set for Friday, Aug. 20.

Hearing in murder case appeal continued

HUTCHINSON, Kan. — Whether it was better policing, the pandemic, or a combination of both, the crime rate in Reno County fell sharply in 2020 compared to the previous year.

According to statistics released Friday by the KBI, there were a total of 94 violent crimes in Reno County compared with 193 in 2019. The county went without a homicide in 2020 and rapes fell from 29 in 2019 to 10 in 2020. Property crimes also fell as theft cases dropped from 1,151 in 2019 to 478 and burglaries fell from 322 to 105.

Motor vehicle thefts also dropped from 83 cases in 2019 to 31 this past year. The overall crime rate per 1,000 citizens fell to 12 from nearly 30 per 1,000 residents in 2019.

Not all of the numbers were positive as the number of murders in the state of Kansas jumped 48% from the previous year and overall violent crimes were up by more than 1,100 across the state.
