HUTCHINSON, Kan. — The City of Hutchinson officially celebrates 150 years as an incorporated city Aug. 18.&nbsp;

Hutchinson and Reno County residents are invited to a free Community Spirit Block Party on this special 150th celebration that will include a mile’s worth of block parties on Main Street from Avenue C through 9th Avenue. Festivities will take place from 6-9 p.m. More than 60 businesses, organizations, civic and community groups, and nonprofits will be providing free activities and entertainment throughout the celebration.

The 150th Celebration Committee is asking for both Hutchinson and Reno County residents to be a part of history in the making through a special historic 150th photograph that will be taken before the evening’s activities. A professional photographer will be taking an aerial photograph of individuals, creating the numbers 1-5-0. A total of 300 participants will be needed for the photograph, which is open to all residents in Hutchinson and Reno County. Participants will need to start gathering by the Crow &amp; Co. Sherman Street entrance in Downtown Hutchinson starting at 5:30 p.m. on Aug. 18. Event organizers will line up all participants at 5:45 p.m., with the photograph taken at 6 p.m.

All photo participants will be entered into a drawing to win a grand prize basket, which will be announced immediately after the picture has been taken. NICKERSON, Kan. — An antique tractor pull and raffle will be held Saturday to help raise funds for the family of Trey Jones.

The event starts at 12:30 p.m. with registration. The pull begins at 2 p.m. east of the water tower on Nickerson Street.&nbsp;

There will also be a gun raffle with first prize being a Charles Daly over/under 20-gauge shotgun and second prize a heritage Rough Rider 22-caliber pistol. Tickets are $10 for one ticket or $50 for six tickets.&nbsp;

Tractor pull Saturday in Nickerson to benefit the Jones family

RENO COUNTY—A Hutchinson man was injured in an accident just before 1:30 p.m. Wednesday in Reno County.

The Kansas Highway Patrol reported a 2001 Peterbilt 379 driven by 66-year-old Steven Bradley Hazen of Hutchinson was southbound on Kansas 61 at Parallel when the vehicle left the roadway to the right. The driver overcorrected and rolled into the ditch.

EMS transported Hazen to Hutchinson Regional Medical Center. He was properly restrained, according to the KHP.

Hutchinson man hospitalized after truck rolls into ditch

RENO COUNTY—A Turon man was injured in an accident just after 1:30 p.m. Wednesday in Reno County.

The Kansas Highway Patrol reported a 1996 Harley Davidson Road King driven by 36-year-old Brian Leon Epp of Turon was eastbound on&nbsp;U.S. 50 at Broadacres when the motorcycle struck the right rear of a 2010 Ford Fusion driven by 17-year-old Kaitlin Brooke Miller of Hutchinson who was&nbsp;slowing to turn South onto Broadacres Road.

EMS transported&nbsp; Epp to Hutchinson Regional Medical Center.&nbsp;Miller was not injured. Epp was not wearing a helmet, according to the KHP.

Reno Co. man hospitalized after motorcycle rear-ends car

LOUISVILLE, Ky. — As reported earlier, the man involved in a car-pedestrian accident that killed Nickerson school teacher Trey Jones and critically injured two other family members will have his case go before a grand jury in Louisville, Kentucky.

However, specifics on the case of Michael Hurley are being kept under wraps as part of normal procedure in Kentucky’s commonwealth court system. Hurley is charged with one count of murder, two counts of aggravated assault in the first degree for the injuries caused to Amy and Ava Jones, and a count of fourth-degree assault for the injuries to Creek Jones.

According to the Courts of the Grand Jury in Louisville, the case will be presented before a grand jury, but the exact date was not released. The general date was the week of Aug. 8. At that time, the case will be presented by the prosecution with the defense allowed to present any findings if it so chooses. If the grand jury decides the case should go forward, a release will be provided with specifics of pre-trial dates and other information. Until then, all is kept under wraps.

Meanwhile, both Ava and Amy Jones continue to improve at a rehab center in Louisville. The hope is both will be able to come home in the next month or so. Funds to help with the Jones’ expenses are still set up at a <a href="https://www.gofundme.com/f/sv8vex-jones-family-fund">GoFundMe page</a> and at Peoples Bank and Trust.

Court case involving Michael Hurley offers few details about grand jury hearing

HUTCHINSON, Kan. — Reno County Deputy Elections Clerk Jenna Fager told Hutch Post there are still quite a few ballots outstanding from Tuesday's primary election, certainly enough to make the Republican District 1 County Commission primary too close to call. The county can still accept mailed ballots through Friday and they will be working on that.

"We'll do a report each day," Fager said. "We're going to have a board come in at 3:30 p.m. every day and process the mailed ballots. They're in here right now, processing any hand count ballots that wouldn't go through the machine and any write ins and that sort of thing, as well."

With record primary turnout of 45%, we received a message from Jenna Fager early Wednesday afternoon that there were 50 provisionals in the District 1 race.

"Our numbers will change," Fager said. "Our final totals won't be in until canvass. We're still trying to tear down our polling places and stuff like that right now."

The three current commissioners are normally the board of canvassers. The canvass is scheduled for Thursday, August 11 at 9 a.m.

"As far as I know, they are going to serve on it," Fager said. "They haven't said otherwise, so if they aren't able to serve, they will appoint somebody to fill their position in serving on the board."

If there is a tie, it will be up to that board to decide how to determine a winner. Usually, that is a coin toss. Whomever ends up behind can stage a write in campaign in November, if they so choose. James Schlickau did just that in a Reno County Commission race in 2016.

UPDATED: Receiving of mailed in ballots continues, provisionals will be part of Aug. 11 canvass

HUTCHINSON, Kan. — The Hutchinson City Council is getting ready to work in earnest on the permanent City Manager search. Consultant Art Davis with Baker Tilly Virchow Krause LLP met with several stakeholder groups and with the council on Monday and the groups want to see some ongoing training.

"One or two of them had actually done research and found out that the International City-County Management Association had a Credentialed Manager status," Davis said. "It's a designation as part of ICMA. It's a voluntary credentialing program. It requires a combination of education, experience and adherence to high standards of integrity and a commitment to continuous education and professional development."

Gary Meagher let his credentials lapse, but he was a credentialed manager earlier in his career.

"You start off by taking an assessment," Meagher said. "As you can imagine, cities differ from all over the state. Some of them have airports and some of them have zoos and so there's no one that knows everything. You take an assessment. It's done by the University of Georgia. It's been validated there. Once you take that assessment, it determines which areas you really need to work on."

Then, there is a plan of action to take classes in those areas in order to gain your credentials.

"You have to have at least 40 hours per year of continuing education," Meagher said. "If you're not a credentialed manager, then you can do any kind of training, as long as it's related to city management, but if you're a credentialed manager, then you are supposed to focus on those areas that you are the weakest."

As an example, Reno County Administrator Randy Partington has his ICMA-CM credentials. The hope is to hire a permanent Hutchinson City Manager by the end of the year.

Stakeholders would like to see new City Manager have ongoing training

The Hutchinson City Council approved a new 2023 contract agreement with the local union representing its firefighters during Tuesday’s agenda session.

"We had one formal meeting with them on July 1st and were able to come to a tentative agreement right away," said HR Director Tom Sanders. "The local membership voted on the contract on the 14th, which passed."

Under the new contract, the city will recognize Martin Luther King Day as an official holiday and will increase monthly holiday pay from 8 hours to 8.8 hours. It also calls for an increase in hourly base pay for firefighters to $14.77 per hour. That amounts to an annual base salary of $43,080. The increase amounts to about 2%. Captains will also see an increase on anywhere from 3.2% to 9.2%. There will also be a mid-year adjustment for merit pay to make up for shortfalls in such pay in 2019 and 2021. Mayor Jade Piros de Carvalho was pleased with the result and thanked leadership from both sides for their work.

"I've noticed a marked difference in the negotiation process with the IAFF since the arrival of Chief Beer a few years ago and I think that is a real testament to your leadership, Chief, and also, Troy, to yours," Piros de Carvalho said. The IAFF are really willing to negotiate in good faith and work collaboratively with the city."

Sanders said they think they may have set a record this year for the speed of negotiations.

"Before the budget passes, imagine that," Piros de Carvalho said. Knowing what's going in the budget before it passes, that's always good."

In 2021, the contract for 2022 was not finalized until October.

Firefighters contract approved Tuesday by Hutch City Council

HUTCHINSON, Kan. — A man who claims to be from Maryland took a unique way to establish a permanent address with his arrest early Wednesday morning.

Robert Laney, who says he is homeless, was arrested at the W. 30th Avenue Yesway store on suspicion of arson. According to the Reno Co. Sheriff’s Department Laney allegedly set fire to a dumpster at the convenience store. When he was detained by law enforcement he said he needed to be taken to jail so he would have a permanent address to collect his disability check and move on from Hutchinson.

He was taken into custody on a bond of $5000. No serious damage occurred from the fire.&nbsp;

Man arrested in arson case wanted permanent address

Kan. —The Newton High school track and football field have reopened, as the skunk situation is slowly improving. 

According to the district, since they have set traps, they have caught 5 of the 11 identified skunks. 

 The district also believes they know where the skunks are living and they are currently taking measures to get them out. 

If you do see a skunk in the area, you are asked to keep a safe distance and notify school officials immediately.

Then at 1:35 this morning, fire crews were called to a garage fire attached to a home. Three people made it out of the home safely, but the garage was heavily damaged and the home is uninhabitable.

2022 Primary election returns

HAVEN, Kan. — The Occupational Safety and Health Administration (OSHA) says its investigation into the April 14 explosion and fire at the Haven Midstream gas facility near Haven is still open. No timeline was given as to when the investigation would conclude, but officials did say that such investigations usually take as long as six months to complete.&nbsp;

The explosions and fire injured two people and forced the evacuation of the town of Haven overnight April 14 and 15.&nbsp;

Since the accident, the IFO Group out of The Woodlands, Texas, has been on hand to assist Haven Midstream in helping with recovery efforts. Neither Haven Midstream nor IFO have disclosed what the plans are for the future of the facility.

The cause of the fire was classified as undetermined by the State Fire Marshal's Office.

Investigation continues into Haven Midstream accident

HAVEN, Kan. — While legal action between the city of Haven and a contractor hired to renovate the city swimming pool remains in the court system, the Haven City Council did decide to move forward with getting the pool back open for next year.

During Monday’s city council meeting, approval was given for a contract with L.J. Roth of Olds, Iowa, to repair and finish the renovation of the pool. The pool has been closed for three summers now after problems came up with the contractor and the condition of the pool. Since then, both sides have been in a legal fight over the matter. With no end to the legal fight in sight, the city has decided to repair the pool and then try to recoup its losses.&nbsp;

Under the contract, L.J. Roth will cut out the concrete and install new material, then install an epoxy coating as per engineers' specifications. The cost of the project is $374,750. Work on the project is scheduled to begin Sept. 6.

Haven City Council approves pool project

HUTCHINSON&nbsp;– Hutchinson Fire Crews responded Tuesday afternoon to 2 S. Nelson St. for a fire in a residential duplex. 

Light smoke was showing from the rear of the structure when they got there.&nbsp;

Firefighters kept the blaze to the room of origin and no one was inside.

Crews rotated through due to the heat, but no injuries were reported. The cause of the fire remains under investigation.

Fire Tuesday afternoon contained to room where it started

NEWTON, Kan. — The Newton City Commission passed an ordinance to create a Rural Housing Incentive District during Tuesday’s regular meeting. The council also adopted the development plan for a proposed multi-family housing project at SE 14th Street near South Pine Street.

The project, called The Enclave at 14th, will consist of seven duplexes for a total of 14 individual units. Central Park Studios LLC of Bel Aire is the developer.

The meeting included a public hearing on the proposal, which originally was on the agenda for July 26.

Under state statute, the Harvey County Commission and USD 373 Board of Education have 30 days to register opposition to the creation of the housing district. If neither party votes to oppose, the ordinance will take effect.

Newton City Council approves new housing district

HUTCHINSON,
Kan. — 
A federal lawsuit has been filed against a Salina and Hutchinson restaurant owner for not paying some of their employees the minimum wage, among other violations.

Documents were filed last week by the U.S. Department of Labor against the owners of Mr. Cao in Hutchinson and Diamaru in Salina, demanding $783,000 alleging that defendants failed to pay two Daimaru employees according to law and including liquidated damages.

The allegations are for actions that are said to have taken place between 2018 and 2020. They are also accused of not paying time and a half for overtime hours and not maintaining correct records of hours worked.

The department also alleges that similar violations occurred in 2015 and that Diamaru agreed to comply going forward in 2016, but that they did not change their practices.

The department also alleges that a couple who both worked in Salina contracted COVID-19 and that Diamaru did not pay proper sick leave during that period.

The lawsuit lists 39 employees at Hutchinson and 52 at Salina.

The Hutchinson City Council approved selling water to Yoder Water District 101 Tuesday. Reno County Public Works Director Don Brittain said it's what they have to do.

"The county appreciates you considering this," Brittain said. "We've had this nitrate problem with the Yoder residents for about a year and a half. It fluctuates up and down, so we tried to wait it out. The way the existing well was drilled in the 80s, I thought maybe nitrate was coming in from the surface or not clear at the bottom of the well. I had a test well drilled just in the last three weeks, which was over $9000. We encased it around the casing to where nitrate levels from the surface couldn't get to the bottom, but we still have high nitrates, even with the new well."

Brittain said they'll get to work on a solution immediately.

"I will start that engineering study tomorrow if you approve it today," Brittain said. "If you do approve it, we will probably be buying water from you. I just had to go through this to see if you'd approve it and then start this engineering and then determine what it's going to cost to run seven miles of water line down there, go underneath the state highway, underneath the river. It's going to be very expensive, but that will all be on us. The only thing that I believe you will provide is connection and a single meter. If we have to have more pressure to get it down there, then it will be on us to put in a pump."

The intent is not to use Hutchinson city water exclusively, at least as Brittain sees it right now.

"What we'll probably do is we'll try to blend your water and their water to try to keep rates down," Brittain said. "Their rates are going to get very high down there for those people. They're going to have to pay for this infrastructure. They're already paying for their infrastructure and I believe we're proposing paying one and a half times what you charge your people. The rates are going to get high down there. This is my last option."

A public town hall meeting is scheduled for residents in and around the Yoder area Thursday, Aug. 11 at 6:30 p.m. at the Journey of Yoder activity center, located two miles north of Yoder.

Hutch City Council approves Yoder water deal

HUTCHINSON, Kan. — Formal charges have been filed against&nbsp; Hutchinson man in a domestic case.

Thirty-seven-year-old Robert Michael is charged with one count of attempted second degree murder stemming from a domestic disturbance July 23rd. The charge is a level 3 person felony which carries a sentence of up to 41 years if convicted, depending on his criminal history.

Michael was arrested after police were dispatched to an address just east of Hutchinson after a neighbor reported a female with facial injuries in front of a residence. The neighbor also reported the female was ushered back inside by a male.

Upon arrival on scene, officers observed the male and female inside but they would not answer the door. Officers had to force entry into the residence. Through the investigation, it was determined the female had injuries consistent with being strangled.

Michael remains jailed on a bond of $250,000. His case will now move to the status docket where a preliminary hearing will be set.

HUTCHINSON, Kan. — Siemens Gamesa today announced decisive steps under the Mistral strategy program to accelerate the company’s turnaround after ending a challenging third quarter marked by ongoing difficulties in the wind energy industry as well as internal challenges mainly impacting the onshore pipeline. The company reported revenue of $2.44 billion, a 10% drop year-over-year.&nbsp; As of June 30, 2022, net debt totaled $2.7 billion.&nbsp;

In a release, the company stated that its performance continued to be negatively affected by inflation of energy, raw material and logistics costs, non-availability of key wind turbine components, port congestion, and supply delays. There were also internal challenges, including a difficult ramp-up of the Siemens Gamesa 5.X onshore platform and higher costs driven mainly by failure of components and repairs in onshore platforms. Those hurdles forced SG to close down the Hutchinson nacelle facility and the plant in Fort Madison, Iowa, although at least two new potential contracts for onshore projects have altered that schedule. SG has not officially announced those projects yet.&nbsp;

The company’s &nbsp;order intake from April to June remained strong at $3.5 billion including $1 billion in new orders in the onshore market, a jump of 27% year over year.&nbsp;&nbsp;

Haven USD 312 enrollment begins Thursday

Kan. — It is primary election day with several primary races up for grabs. There are three seats up for grabs for Reno County Commission. One is the seat being vacated by Ron Sellers in District 1. Cris
Corey and Randall Parks will vie for that seat on the Republican side. There is no Democrat in that race.

Also up for
grabs are the two new seats with the expanded commission that was voted up by
the public. In District 4, Democrat Michael Jobe and Republican Mark Reese will
face off in the general election. In District 5, there are four Republicans
vying for the seat: Don Bogner, Tom Collins, Mike Warren and Penelope
Poitras. There is no Democrat in that race.

There are
also a number of township positions on the ballot depending on where you live
in the county. There is also one state legislative primary for the area. In House District 101, Joe Seiwert is being opposed by former Goddard Mayor Jamey
Blubaugh.

One
ballot question that will certainly be watched is the abortion regulation question. That
alone could drive up voter turnout to above 30%, according to Reno County Deputy
Elections Clerk Jenna Fager. 

Advance voting has been brisk with 3,375 votes cast ahead of today’s vote and another 1,800-plus mailed-out ballots. Polls are open until 7 p.m. and any mailed-out ballots
must be returned to the Reno County Clerk’s Office at the Reno County Annex by 7

In-person enrollment for 7th through 12th grades in Hutchinson USD 308, including Virtual School is today at the school buildings from 10 a.m. to&nbsp; 6 p.m.

The enrollment fee for each K-12 student is $65. Optional fees include yearbook and activity passes for students in grades 7 through 12.

School meals will no longer be free for all students effective the start of the 2022-23 school year. Families will need to fill out the Free &amp; Reduced Meal Application in order to be considered for free or reduced meals and textbook fees.

Parents are reminded to check with their pediatricians for any needed vaccinations and physicals. Athletic physicals must be done after May 1, 2022, and be on file before the first day of fall practice.

Students will not be allowed to attend class in August until all required vaccinations and physicals are on file. All student immunization documentation must be on file before students are fully enrolled.

If you are comfortable, enrollment is already available&nbsp;<a href="https://skyward.usd308.com/scripts/wsisa.dll/WService=wsSky/seplog01.w">online</a>&nbsp;for returning students.

USD 308 grades 7 to 12 in person enrollment today

MCPHERSON COUNTY — Two people were injured in an accident just after 10:30 a.m. Monday in McPherson County.

The Kansas Highway Patrol reported a 2022 Toyota RAV 4 driven by 69-year-old Cecil Toews of Box Island, Alberta, Canada, was eastbound on Kansas 61 attempting to exit onto northbound Interstate 135. 

The driver failed to make the turn for the entrance. The vehicle traveled off the road and came to rest at the bottom of the ditch.

EMS transported&nbsp;Toews and a passenger, 68-year-old Helen&nbsp;Toews, Box Island, Alberta, Canada, to the hospital in McPherson. They were properly restrained, according to the KHP.

Hutchinson police chief Jeff Hooper said there have been more than 20 vandalism reports related to political signs for the constitutional amendment question that is on the ballot Tuesday.

"This is a controversial topic," Hooper said. "Many people are very passionate about it. We've seen either vandalism or stolen signs on both sides."

The problem is that most of the signs are identical.

"There's no unique features to those particular signs," Hooper said. "A lot of people have reported them to us, but haven't really desired a criminal report. A lot of people are just, obviously upset about it and wanted to let us know that it's occurring. Officers are patrolling residential areas and trying to keep an eye out for that, but you know, it's just kind of, you know, a shot in the dark, hit and miss, whether we would catch somebody in progress. Obviously, we would take action if we did, but short of that, it's a very tough case to prove."

Hooper didn't have any numbers as to how many of each type were taken or vandalized, but he did say any of those actions are likely misdemeanors.

"It kind of depends a little bit on where these signs are," Hooper said. "A lot of these signs are on private property. It certainly would be criminal trespass, in that people are illegally trespassing on somebody's private property and then theft. These signs aren't monetarily valued very high, so it would just be misdemeanor theft, so both of those cases are misdemeanors. Relatively speaking, in the criminal justice world, those are minor criminal offenses. I think the political implications are more substantial and meaningful to our community."

If you have video from a Ring doorbell or other camera that can help the police in their investigation, contact them and make sure they have it, along with timestamps of when the video was taken, so they can cross reference it with a complaint.
