NEWTON, Kan. —According to Newton City Manager Kelly McElroy, design work by HBM Architects continues for the new Newton Public Library building.

The campaign for the new building received a $50,000 gift announced <a href="https://www.newtonplks.org/2022/08/new-library-campaign-receives-major-gift/">on the library's blog</a> August 31 from the Lewis H. Humphreys Charitable Trust, Bank of America, N.A., of Lebo, Kansas. This moves the campaign past the $2.4 million mark in total funds raised.

Lewis Humphreys was a farmer, rancher and World War II veteran. His trust was established years ago to help youth and to advance education.

The campaign's goal is to raise $2.7 million to help fund the construction of a new Newton Public Library.&nbsp;

The proposed new library will be built immediately adjacent to the existing library in Military Park, near downtown Newton. The City of Newton and Newton Public Library have committed funds to the project, with private donations needed to fund the balance.

MANHATTAN, Kansas — Grain growers in central Kansas who plan to campaign for a seat on one of the state’s five grain commodity commissions — corn, grain sorghum, soybeans, wheat or sunflowers — should be gathering petition signatures now to meet the November 30, 2022, filing deadline. The 2023 election will cover districts four, five, and six; or the central third of Kansas. &nbsp;

To be eligible to run for any of the five commodity commissions, the candidate must have been actively engaged in growing that commodity (corn, grain sorghum, soybeans, wheat or sunflowers) within the preceding five years and may only represent the district of their primary residence.

Commodity Commission Candidates Must File by Nov. 30

Instructors from the Federal Law Enforcement Training Center (FLETC) concluded their two-week Use of Force Instructor Training Program Friday at the Kansas Law Enforcement Training Center (KLETC).

The program provided the attending officers with foundational information and skills to design, develop, deliver, and evaluate others making critical decisions related to using force. The first week of the program covered constitutional foundations, in conjunction with the Constitution's Fourth Amendment, and how previous Supreme Court rulings play into the use of force.

"There is no more important topic in law enforcement training than the constitutional limits on the use of force," said KLETC Executive Director Darin Beck. "We appreciated our federal partners coming to Kansas to train experienced officers in not only the latest law but the most effective instructional methods."

"The first couple of days of the program is a refresher for the officers," said FLETC Lead Instructor Christopher Lair. "We travel with an in-house attorney and specifically discuss these cases and how they apply to police uses of force."

Lair said the Supreme Court Case Graham v. Connor is the foundational playbook for what law enforcement officers can do regarding the use of force. The 1989 Supreme Court ruling outlined several factors used to determine whether police force is reasonable, including the "severity of the crime at issue," "whether the suspect poses an immediate threat to the safety of the officers or others," and "whether he is actively resisting or attempting to evade arrest by flight."

The second week of the program became more dynamic and involved the use of force scenarios, some of which were designed by the participants. Paul Sullivan, a Senior Instructor for FLETC and a graduate of KLETC's 126th Basic Training Class, said that the instructors ran the students through FLETC scenarios before having them write their own.

"They were able to get hands-on experience," he said. "It's not only about the student going through a scenario use of force encounter, but how that student can write one and then take their classmates and run them through the scenarios."

Officer Faith Jolly of the Gardner Police Department enjoyed the program and commented that there was a lot of valuable information. She found that the practical scenarios were particularly applicable and realistic.

"The practice exercises really stood out," said Jolly. "The realistic training over real-life scenarios will be crucial when training officers at my agency."

To graduate, the participants must pass a written multiple-choice exam, answer and discuss questions related to the use of force, and successfully develop five graded practical exercises. The 21 participants who completed the course came from law enforcement agencies throughout Kansas and Missouri. They will take their knowledge from this program and instruct others at their agencies.

"We understand that two weeks is a big ask for a lot of these departments, and we are grateful for the class of 21 that we have," said Lair. "The time and dedication of the officers to attend such an intensive two-week course is a testament to their agencies.”

"If you have an area that's already covered by another federal grant, then you can't receive this federal grant," Piros de Carvalho said. "The problem is, the Treasury award, they're part of the American Rescue Plan Act."

That law requires funds be expended in around two years, and preferential treatment is given to in-ground broadband like fiber and cable. The NextLink service in Kansas, as Piros de Carvalho understands it now, is based on wireless, and the RDOF funds have an eight-year build out horizon.

"I just need to reach out to NextLink," Piros de Carvalho said. "I've been texting them. I need to call with them. I'd like to see what their build out schedule for Kansas is. They got RDOF in a lot of states."

The expansion of broadband by all possible methods is the goal, but connectivity is always better sooner than later.

Public comments are being accepted for the submitted applications for the state administered Capital Projects Fund-Infrastructure Program until September 9. To the degree that this narrows the number of eligible applications, it may help some non-Nextlink connected areas to qualify.

"It's helpful in that we know that those NextLink awarded areas will be considered served, so we can knock them out of our program's consideration."

The service providers’ funding requests for the CPF program total almost $600 million for the available $83.5 million in funding provided by the U.S. Department of Treasury under the American Rescue Plan Act.

Piros de Carvalho: FCC award to large provider could help other small Kansas providers

Jace Chambers with the Hutchinson Art Center said it is the time of year for submissions to the annual members art show at the center.

"We've been having this annual show for decades now," said director Jace Chambers. "It goes back almost as far as art association and art center history does. It's just a way for us to celebrate and thank our artist members for being so supportive and enjoy their artwork that they've created within the past two years."

Any current members or new members that join can be a part, but they have to pick their best single piece, with limited exceptions.

"We're accepting two dimensional, three dimensional, we'll even talk about installation art," Chambers said. "I think the only thing we're not accepting at this time is performance art."

It's a fairly well represented show in most years, too.

"In slower years, where things have been harder for everyone, 2020 and 2021 for example, there can be lower turnouts, like 30 or 40, but we've had as many as 80 artists participate before in the past," Chambers said. "It can really run the gamut. The bigger the show, the more fun we have."

The Art Center is accepting submissions through September 29th.

StartUp Hutch is looking to help small business owners get additional financing if they want to start or expand. Through Network Kansas, the GROWKS Loan Fund Program offers a variety of matching loan programs to support Kansas businesses.

"The two loan funds that we are most likely to use are the Minority and Women-Led Starter Loans and Rural/Urban Distressed Loans," Swearer said. "Starter loans doesn't only apply to startups. That can also be any kind of new expansion of a business."

This is for expansion of a small business.

"When I say small, I mean up to a $100,000 loan from this fund," Swearer said. "For some people, that could be quite a big project."

Owners who want to use these funds have to have secured other financing, too.

The Hutchinson USD 308 school board recently approved a second school resource officer for the district and police chief Jeff Hooper is glad to be able to provide that resource.

"I'm really excited about that," Hooper said. "The city council first approved that as part of my budget for this budget cycle, so I was thankful for the city council, then I approached Dr. Dawn Johnson and she was able to get funding through the school board for the other half for that school resource officer. Safety of our kids is paramount. They are our future. I think you'd be naive if you're not paying attention to what's going on in the world, if you think active violence couldn't happen here."

That's why the department is changing a little bit about how it helps teachers practice what to do in 308 buildings by having all buildings do some of the same preparation.

"Up until this point, it's been left up to the individual principals whether they wanted us to come in and conduct those assessments and drills inside their schools," Hooper said. "Some of them would, some of them would not. We are working on a plan now to make that standard across the district, just like fire drills or tornado drills would be."

This training will likely happen with just staff in the school as part of professional development.

"Unfortunately, we've had enough of these active violence incidents to realize what works and what doesn't work and the chance of success and saving lives largely is dependent on the action of those teachers," Hooper said. "That's a vital piece."

Hooper said it takes a special type of officer to build the relationships with the students, but it's those relationships that help keep kids safe at school.

Hooper: Second SRO, streamlined procedures will help with school security

HUTCHINSON, Kan. — The Health Resources &amp; Services Administration, a division of the&nbsp;U.S. Department of Health and Human Services, has awarded PrairieStar Health Center 7 additional national awards.

PrairieStar received the gold award for Health Center Quality Leaders, which is given to only the top 10% of all Federally Qualified Health Centers in the nation. The award is given based on achieving the best overall clinical quality measure (CQM) performance among all health centers.

In addition, PrairieStar received the National Quality Leader award for heart health, ranking them in the top 1-2% of all FQHCs for management of conditions that affect heart health including hypertension control, use of aspirin, and tobacco use screening.

“It is a testament to the work and dedication of our family medicine providers,” said Bryant Anderson, Chief Executive Officer.

PrairieStar also received awards for reducing health disparities, advancing healthcare IT for quality, increasing access to medical care for patients, addressing social factors, and maintaining a Level III Patient-Centered Medical Home designation, the highest level obtainable.

Since 2015, PrairieStar has earned 44 national quality awards. “This national recognition is certainly an indicator of the quality of care that patients receive at PrairieStar,” said Anderson.

RFPs sought for new McPherson fire station

HUTCHINSON, Kan. — Hutchinson police were called out Thursday afternoon at 3:08 p.m. to the Porter Commons apartment complex at 1417 Katie Drive.&nbsp;

A woman was found there with facial injuries and apparent broken bones. There was evidence that her apartment door was forced open. Several people were inside when the door was kicked in.

There were several bullet holes on the exterior of several apartments and two more victims were in the area when gunshots were fired by a man later identified as 24-year-old Dakota Ney.&nbsp;

Ney was arrested for two counts of aggravated assault, four counts of aggravated burglary, shooting into an occupied dwelling, felony criminal damage and misdemeanor criminal damage, along with felon in possession of a firearm.

Located elsewhere and also arrested was 21-year-old Aryanna Fernandez for aggravated battery and four counts of aggravated burglary.

This case is still an active investigation and anyone with information is asked to contact Reno County Crime Stoppers at 1-800-222 TIPS  or Sergeant Jones at 620-694-2822.&nbsp; 

All parties are presumed innocent until found guilty in a court of law.&nbsp;

Two Hutchinson residents arrested after shots fired at apartment complex Thursday

The Revenue Neutral Rate and budget hearings for the City of Hutchinson are scheduled for Tuesday.

City Manager Gary Meagher met with department heads and they were able to find more than $1.2 million in cuts to close out 2022 and for 2023.

They include holding some open positions vacant in the police department saving about $493,000, cutting $238,000 from the motor and equipment reserve fund, and making another $245,000 in cuts in department operating expenses. It also includes more than $224,000 in cuts to the street department.

The city is having to make the cuts to keep the mill levy at 41.556 mills. The cuts offset a 7% increase in valuations for 2023 and will, if nothing else changes, keep the budget at revenue neutral for the coming year. 

However, the city is holding the&nbsp;Revenue Neutral Rate hearing just in case an emergency event or a miscalculation by another agency would inadvertently push them above a flat actual collection, because if that happened and they didn't hold the hearing, they would have to give the excess back.

The city budget also includes the Hutchinson Recreation Commission budget with a 2023 mill levy rate of 3.613, which is above revenue neutral for them, but they have held the required hearings.

Since the budget was discussed, the opioid fund was added, because there was some money passed down from the state. Police department salaries were increased by $24,262 for the FOP negotiations and a $2 million transfer happened from the stormwater fund to the CIP fund to pay for the Mine Road project. Estimated costs on that are about $1.9 million.

The budget, if it is passed on Tuesday, would be the most that can be spent by the city, but they can always spend less if they can find areas to save as the year goes along.

The Hutchinson City Council meets Tuesday morning at 9 a.m. at City Hall.

City will have hearing for revenue neutral rate and budget Tuesday

TOPEKA, Kan. – McPherson High School has been selected as the KSHSAA Performing Arts School of Excellence award winner. A total of 17 Kansas high schools will receive recognition by the Kansas State High School Activities Association (KSHSAA) for outstanding performing arts programs.

A selection committee was formed from the following associations: Kansas Music Educators Association (KMEA), Kansas Speech Communication Association (KSCA) and the Kansas Thespians (Theatre).

Leaders from these three associations along with the KSHSAA staff collaborated to discuss numerous high schools that scored exceptionally high in debate, speech, music, and theater during the 2021-22 school year. The committee and the KSHSAA chose one winner, three finalists and 13 commended schools from across Kansas. All 17 schools will be recognized with a certificate from the KSHSAA in September.

The official date has been set for the resolution of a fence dispute in Reno County. It will be September 8.

Lauren and Wayne Sill of 2319 North Mayfield Road have requested a fence viewing to resolve a boundary dispute with adjacent neighbors Christopher and Nicole Schroeder at 2509 North Mayfield Road.

According to a letter from Lauren and Wayne Sill provided to commissioners as part of their agenda documents when the date was set, the Sills bought the land in 2017 and exchanged quit claim deeds with previous owners to correct two boundary lines and address issues with the location of the previous owners driveway.

The Sills say in their letter that they built a fence on the north-south boundary and took out trees and brush for fire mitigation. They say they did their best to stay within three feet of the boundary.

The Schroeders say the fence isn't where it should be and that the Sills left debris on their property and damaged their mower. The Sills say they got a demand letter from the Schroeders that asks for money for the mower damage and to repair the fence. The Sills are asking that if a fence is built, that the cost is shared between the two.

The Board of County Commissioners of Reno County, Kansas, acting as fence viewers, at the request of Lauren Sill and Wayne Sill, will proceed to the location of a partition fence common to a certain tract in the Northeast Quarter of Section Two (2), Township Twenty-three (23) South, Range Five (5) Wests of the 6th P.M., Reno County, Kansas, on September 8th 2022 at 9:00 a.m. to review said partition fence and to assign to the respective owners of said adjoining quarter sections, in writing, his, her or their share or part of said partition fence to be by him, her or them kept up and maintained in good repair, all pursuant to K.S.A. 29-304.

The letter was sent to the Schroeders on August 23.

&nbsp;The 2022-23 honorees are Terry Bisbee, class of 1966; Robert “Bob” Johnson, class of 1940; and Fred Kaplan, class of 1972.

After graduating Hutchinson High School in 1966, Mr. Bisbee obtained an Associates Degree in Drafting Technology from Hutchinson Junior College. Upon graduation he was hired by Sandia National Laboratories in Albuquerque, New Mexico. Sandia is one of the nation’s primary research and development labs with a charter to “provide exceptional service in the national interest”. While working at Sandia, he continued his education at the University of Albuquerque and the University of New Mexico. Moving through the ranks during his 40-year career, he had the opportunity to work on numerous projects developing technical solutions to critical national security challenges. In his position as a Program Manager in the Security Systems Center, he was responsible for over-seeing security projects at Air Force bases, launch sites, and critical infrastructure facilities in the U.S. and Europe. This experience led to his selection as the Nuclear Surety Technical Advisor at the United States European Command Headquarters in Stuttgart, Germany where he served for six years. Terry retired from Sandia in 2008 as a Principal Member of Technical Staff. In 2012, Terry and his wife, Dee, made the decision to return to Hutchinson desiring to become involved in the community where he received the education that laid the foundation for a successful career. He currently sits on the Board of Trustees at Hutchinson Community College, serves on advisory boards at HutchCC and HHS, served on the Hutchinson Planning Commission, and volunteers with several community organizations. Terry and his wife support various community causes including the Hutchinson Symphony, Fox Theater, and Hutchinson Community College.

Before he helped establish the Emergency Shelter Home for abused and neglected children, Bob would bring these children to his home where his wife would bathe, feed and put them to bed with their own children. Helping families and children became a way of life for Bob until 1980 when he died of cancer.

After graduating in 1976, Fred received a B.A. from Oberlin College and an M.S. and Ph.D. In political science from M.I.T. In between the two graduate degrees, he worked on Capitol Hill for two years as a legislative aide on foreign policy and wrote his first book (“The Wizards of Armageddon”), which he turned into his doctoral dissertation. He then joined the staff of the Boston Globe, working as its defense reporter (1983-91), Moscow bureau chief (1992-95), and New York bureau chief (1995-2002). As the Iraq war began in 2003, he was hired by Slate, where he has been the “War Stories” columnist ever since. He won a Pulitzer Prize for reporting on the nuclear arms race in 1983, and his 2013 book “The Insurgents” (one of six that he’s written) was a Pulitzer Prize Finalist. He thanks a few HHS teachers—Del Knauer, Jack Sexton, John Garland, and Esther Ogle—for encouraging him as a writer and helping to shape him as a thinker.

Hutchinson High School Wall of Honor to induct three Sept. 15

The Emergency Use Authorization (EUA) for the Moderna and Pfizer Vaccine was updated on 8/31/22 by the FDA, so that means no boosters can be given to ages 12 or over in Kansas for a little while.

"The CDC has recently approved the administration of a bivalent," said Reno County Health Department Director Karla Nichols. "The new making of this new vaccine is a bivalent, meaning two versions of the vaccine, the original COVID strain and then there's another one for the BA.4 and BA.5 Omicron subvariants. It's like a two variant strain, so it's going to cover better."

But, until they get the new one in, they aren't allowed to give the old one as boosters, but only as primary and secondary doses to those who have never had the COVID-19 vaccine before.

"The ACIP has not met yet and authorized the same thing that the FDA did," Nichols said. "The ACIP is meeting today for that authorization. For us, in the state of Kansas, KDHE cannot authorize the distribution of that bivalent yet, because the ACIP has not met yet."

Nichols anticipates that they will be able to order the new vaccine and get it shortly after the holiday.

"People that want their booster dose, we're not able to give that to them," Nichols said. "The good thing is, probably around Sept. 12, we should be getting a bivalent that's going to cover better for that booster dose of the COVID-19 vaccine."

When the new dose comes in, you will only have had to have the original two doses to get the third one, once it is approved and available.

Health Dept.: No COVID boosters for a few days

MCPHERSON, Kan. — A fire that started Tuesday at the McPherson Area Solid Waste Utility transfer station is expected to burn into the weekend and possibly next week. No one was hurt.

According to information from the McPherson Fire Department, crews will continue to monitor the fire and wind conditions in the coming days.

MASWU fire will likely linger

HUTCHINSON, Kan. — The pool is closed for the season, but if the weather gets too hot, the splash pads in the city will be open a little bit longer.&nbsp;

The City of Hutchinson announced that the splash pad at State Fair Park will close after Labor Day, because of the approaching fair.

The other splash pads at Rice Park and Avenue A Park will remain operational until Monday, Sept. 26.

Fair splash pad closes Tuesday, others stay open until Sept. 26

HUTCHINSON, Kan. — A Kansas Supreme Court hearing for a Hutchinson man has been continued at the request of the Reno County District Attorney's office.

Brennan Trass is serving a life sentence in the 2015 shooting death of Jose Morales. Morales was shot three times while he had his back to Trass during a drug deal. Trass has maintained it was self-defense. Trass was convicted of first-degree murder and criminal possession of a firearm by a felon. He is appealing his case citing speedy trial issues and that the court erred by having Trass represent himself in court.

Trass represented himself at the request of the courts after he exhausted all of the possible attorneys in the area. Trass went through 13 members of counsel before the action was taken by Judge Trish Rose.

But during the process of making a transition from one attorney to another, Tras was given a mental evaluation at the request of the defense and was found to be competent to stand trial. However, a formal hearing to make a ruling of the court was never held. While it might not be a major detail in the appeal, District Attorney Tom Stanton wanted to make sure all bases are covered and asked that the case be remanded back to court for that hearing.&nbsp;

If Judge Rose goes with the competency report, then the case will go back to the Kansas Supreme Court to address the appeal, if not, then questions will have to be addressed about where the case could go from there.

The Kansas State Fair will have Automated External Defibrillator (AED) devices on the grounds this September thanks to a partnership with the Blue Cross and Blue Shield of Kansas Foundation. These lifesaving medical equipment pieces will be placed in eleven buildings on the fairgrounds.&nbsp;

Prior to August 2022, there were no AEDs available on the fairgrounds and the fair had to rely on the Hutchinson Fire Department or Emergency Medical Services.&nbsp; The Kansas State Fair averages over 340,000 guests during the ten days of the annual September event. Over 450 non-Fair events occur across the grounds in a twelve-month period.&nbsp;

The devices will be in the Pride of Kansas, Meadowlark, Sunflower South, Sunflower North, 4H Centennial Hall, Domestic Arts, Encampment, Cottonwood Court, Grandstand, EXPO Center and the&nbsp;Prairie Pavilion.

 Events such as RV rallies, Mennonite Relief Sale, Kansas Beef Expo, Skills USA, Kansas Junior Livestock Show, and numerous weddings, reunions, and family gatherings happen every year in addition to the fair.&nbsp; &nbsp; &nbsp;&nbsp;

Defibrillators now on fairgrounds for 2022

LOUISVILLE, Ky. — The man who struck a Nickerson family with his vehicle in Louisville, Kentucky has been indicted by a grand jury in Jefferson County Commonwealth Court.

The Jefferson County Grand Jury returned the indictment against Michael Hurley charging him with one count of Murder, two counts of Assault First Degree, one count of Assault Fourth Degree, and one count of Operating a Motor Vehicle Under the Influence.

The indicted charges are in connection with the July 5 incident when Hurley struck the family of Trey Jones with his automobile, killing the popular teacher and track coach and critically injuring his wife Amy and daughter Ava while they were standing on a sidewalk in downtown Louisville.&nbsp;

The case has been assigned to Division 2 of Jefferson County Circuit Court. Hurley will be formally arraigned on Tuesday, September 6.&nbsp;

That's also the case in Nickerson-South Hutchinson USD 309, though the date for their proposed $10.5 million bond has not been set yet. They are finishing up looking at some science upgrades with capital outlay dollars first, but then it's time to talk to the public about what they want beyond that.

"We really plan to turn our attention on getting community input," said USD 309 Superintendent Curtis Nightingale. "We're trying to put together some type of a plan that would make some sense in terms of the dollars that we could gather and spend to bring our facilities up to that next level."

The board agreed in principle back in February to try to hold to a ten-year bond at the $10.5 million price point.

"A lot of buildings were built during the old works projects in the late 40s and early to mid 50s," Nightingale said. "Our facilities are getting quite a bit older and we have to start looking at shelf life of those facilities. Are the structures themselves sound? If so, many of them have not been updated in decades."

It's important that those who are interested not only in education, but more broadly in the future of the community look at what investing in schools can help with.

"If there's a community perception out there that you've got run-down facilities, they're going to rank your district low and know, if that's occurring, that effects property value," Nightingale said. "While you might think, well, I don't have a kid in the building, physically, I don't either, my kids are both grown, as well. I don't have a kid in the building either. However, the quality of our schools not only speaks to my property value, selfishly, but as a society, you're talking about quality of life in a society."

Nickerson USD 309's last bond failed. It would have been a $30 million bond and was rejected in 2019.

Bond process in Nickerson district will continue with community input soon

HUTCHINSON, Kan. — The four Republicans running in Reno County's legislative races received the endorsement of&nbsp;The NFIB Kansas PAC on Wednesday.&nbsp; 

District 101&nbsp; &nbsp; &nbsp;Joe Seiwert District 102&nbsp;&nbsp; &nbsp;John Whitesel&nbsp; District 104&nbsp;&nbsp; &nbsp;Paul Waggoner District 114&nbsp;&nbsp; &nbsp;Michael Murphy&nbsp;&nbsp;

Seiwert, Waggoner and Murphy are the incumbents in their races, while Whitesel is challenging Jason Probst in District 102.

Four Reno County Republican statehouse candidates endorsed by NFIB Kansas PAC

Reno County Deputy Elections Clerk Jenna Fager said that with Cris Corey launching a formal write-in campaign for the District 1 seat on the Board of County Commissioners, she'll have some additional workers on hand in November.

"We do have a chart that we give the board workers," Fager said. "It's basically state guidelines on how we count write-ins," Fager said. "If the voter shows voter intent that they are wanting to vote for that candidate, then the board is instructed to count it."

Though votes are always finalized with the canvass, the hope is to be able to do the necessary counting to give people an idea, even on Nov. 8.

"It is something that we always deal with," Fager said. "When we have somebody that is knowingly running a write in campaign, what we do is, we actually bring in a board to come in and do a count on those, so we can kind of get some results on election night, instead of just guessing."

However, no additional instructions are given to voters that may be mailing in their ballots or things like that, it is up to the candidate to explain what needs to be written to prove intent.

Generally, unless more than one candidate has the same last name, a last name alone is counted. Misspellings of the correct first name are counted, but an incorrect first name with a correct last name is generally not counted.
