Posted May 08, 2026 10:30 AM

KANSAS CITY—A man critically injured in a shooting last month in Kansas City, Missouri has died.  The victim identified as 34-year-old Robert W. Smith, according to KCPD Captain Jake Becchina.

Just after noon April 29, police were dispatched to a shooting at NE 38th Street and N. Holmes Street. First responders found Smith lying in the roadway suffering from an apparent gunshot wound.

EMS responded and transported him to the hospital with life-threatening injuries.

Detectives and Crime Scene Investigators responded to the scene for processing of evidence and investigation.  An aggravated assault investigation ensued. Investigation indicated the victim was at the location when he had an interaction with a group of individuals. That interaction escalated to gunfire which struck Smith. Investigation led detectives to a subject of interest at a nearby location where he was taken into custody.

On April 30, Clay County Prosecutor’s Office charged that subject, in custody, with Assault in the First Degree and Armed Criminal Action. On May 6, detectives were notified Smith died from his injuries from the shooting.

At that time, the Homicide Unit’ assumed responsibility for the investigation. Detectives are in contact with the prosecutors office and are submitting the necessary reports and documents in order for the charges to be upgraded.
