SEDGWICK COUNTY —Law enforcement are investigating a hit-and-run collision and asking the public for help to locate a suspect vehicle.

Just after 9:30p.m. June 1, police responded to an injury collision in the area of South Hydraulic and East Wassall, according to a social media report.

 When officers arrived, they located two motorcycle riders, a 24-year-old man and a 26-year-old woman, lying in the roadway. 

Investigators learned that a tan/gold Chevrolet Impala failed to yield to the motorcycle, resulting in a collision between the motorcycle and the passenger side of the Chevrolet Impala.

Police ask for help to ID car in Kan. motorcycle hit-and-run

KANSAS CITY — Lee's Summit police officer, Jared Timbrook, shot four times while pursuing a suspect on Sunday is out of the hospital.

"Officer Timbrook was treated by his fellow officers on scene and he was transported to an area trauma center by the paramedics of the Lee’s Summit Fire Department," according to a media release from the department.

"On Tuesday afternoon, Timbrook was released from the hospital to continue his healing journey at home."

"On behalf of Officer Timbrook and his family along with the men and women of the Lee's Summit Police Deparatment, we are thankful for the amazing care that he received and the outpouring of support for him from this amazing community." Officer Timbrook has been with the LSPD for approximately 18 months and comes to the department with approximately 7 years of experience with his previous agency."

Meanwhile the suspect Thomas Tolbert has been charged with&nbsp; 1st Degree Assault, Armed Criminal Action, Unlawful Possession of a Firearm, Resisting Arrest/Detention/Stop by Fleeing, and 2nd Degree Domestic Assault in connection with the incident, according to Jackson County Prosecutor Melesa Johnson.

<a href="https://www.jacksoncountyprosecutor.com/DocumentCenter/View/2636/484693-PC-Statement-Tolbert-Thomas_Redacted">According to court records</a>, Lee’s Summit police were dispatched to an apartment complex near SW Hollywood Drive and Highway 150 on June 1 regarding a man, later identified as Tolbert who was allegedly involved in a domestic assault with the victim. &nbsp;

Upon arrival, an officer approached Tolbert in the parking lot of the complex and attempted to detain him. Tolbert broke away and began to run. As the officer ran after him, the defendant began to fire multiple gunshots at the officer, striking him four times. The officer was hit in the left leg, left arm, chest of his body armor, and his shoulder.&nbsp;

Area legislators have raised questions about why Hardin was being held at the Calico Rock facility.

The letter was sent Monday by Republican Rep. Howard Beaty and Sen. Matt McKee to Benny Magness, who heads the state board.

“Given Hardin’s background as a former law enforcement officer and his history of working for multiple law enforcement agencies, it is evident that he possesses knowledge and skills that enabled him to exploit weaknesses in our security protocols,” the lawmakers wrote. Manhunt continues: Reward increased for police chief turned killer

WASHINGTON (AP) — The Trump administration announced on Tuesday that it would revoke guidance to the nation’s hospitals that directed them to provide emergency&nbsp;<a href="https://apnews.com/hub/abortion">abortions</a>&nbsp;for women when they are necessary to stabilize their medical condition.

That&nbsp;<a href="https://apnews.com/article/abortion-emergency-room-law-biden-supreme-court-1564fa3f72268114e65f78848c47402b">guidance</a>&nbsp;was issued to hospitals in 2022, weeks after the U.S. Supreme Court upended national abortion rights in the U.S. It was an effort by the Biden administration to preserve abortion access for extreme cases in which women were experiencing medical emergencies and needed an abortion to prevent organ loss or severe hemorrhaging, among other serious complications.

The Biden administration had argued that hospitals — including ones in states with near-total bans — needed to provide emergency abortions under the Emergency Medical Treatment and Active Labor Act. That law requires emergency rooms that receive Medicare dollars to provide an exam and stabilizing treatment for all patients. Nearly all emergency rooms in the U.S. rely on Medicare funds.

The Trump administration announced on Tuesday that it would no longer enforce that policy.

The move prompted concerns from some doctors and abortion rights advocates that women will not get emergency abortions in states with strict bans.

“The Trump Administration would rather women die in emergency rooms than receive life-saving abortions,” Nancy Northup, president and CEO of the Center for Reproductive Rights, said in a statement. “In pulling back guidance, this administration is feeding the fear and confusion that already exists at hospitals in every state where abortion is banned. Hospitals need more guidance, not less, to stop them from turning away patients experiencing pregnancy crises.”

Anti-abortion advocates, meanwhile, praised the announcement. Marjorie Dannenfelser, president of SBA Pro-Life America, said in a statement that the Biden-era policy had been a way to expand abortion access in states where it was banned.

“Democrats have created confusion on this fact to justify their extremely unpopular agenda for all-trimester abortion,” she said. “In situations where every minute counts, their lies lead to delayed care and put women in needless, unacceptable danger.”

An Associated Press&nbsp;<a href="https://apnews.com/article/pregnant-women-emergency-room-ectopic-er-edd66276d2f6c412c988051b618fb8f9">investigation</a>&nbsp;last year found that, even with the Biden administration’s guidance, dozens of pregnant women were being turned away from emergency rooms, including some who needed emergency abortions.

The Centers for Medicare and Medicaid Services, which provides oversight of hospitals, said in a statement that it will continue to enforce the federal law that, “including for identified emergency medical conditions that place the health of a pregnant woman or her unborn child in serious jeopardy.”

But CMS added that it would also “rectify any perceived legal confusion and instability created by the former administration’s actions.”

Trump admin. revokes guidance requiring hospitals to provide emergency abortions

DETROIT (AP) — A Chinese scientist entered the U.S. last year with a toxic fungus stashed in his backpack, federal authorities said Tuesday as they filed charges against him and a girlfriend who worked in a lab at the University of Michigan.

The pathogen is known as Fusarium graminearum, which can attack wheat, barley, maize and rice and sicken livestock and people, the FBI said in a court filing in Detroit.

The FBI said a scientific journal describes it as a “potential agroterrorism weapon.”

Yunqing Jian, 33, and Zunyong Liu, 34, were charged with conspiracy, smuggling, making false statements and visa fraud.

“The alleged actions of these Chinese nationals, including a loyal member of the Chinese Communist Party, are of the gravest national security concerns,” U.S. Attorney Jerome Gorgon Jr. said.

Jian appeared in court and was returned to jail to await a bond hearing Thursday. An attorney who was assigned only for her initial appearance declined to comment.

In July 2024, Liu was turned away at the Detroit airport and sent back to China after changing his story during an interrogation about red plant material discovered in his backpack, the FBI said.

He initially claimed ignorance about the samples but later said he was planning to use the material for research at a University of Michigan lab where Jian worked and where Liu previously worked, the FBI said.

The FBI said Liu replied: “Once this is done, everything else will be easy.”

Months later, in February, FBI agents visited Jian at the campus lab. She said, “100% no,” when asked if she had been assisting Liu with the pathogen at the lab. The FBI said it found a signed statement on her phone expressing her support for the Communist Party of China.

Messages between the two in 2024 suggest that Jian was already tending to Fusarium graminearum at the campus lab before Liu was caught at the Detroit airport, the FBI said. The university does not have federal permits to handle it.

The U.S. does not have an extradition treaty with China, which makes Liu’s arrest unlikely unless he returns.

Chinese couple charged with smuggling biological pathogen into the U.S.

CAMDEN COUNTY, Mo.— Two people were injured in an accident just before 6p.m. Monday at Lake of the Ozarks.

The&nbsp;Missouri State Highway Patrol&nbsp;reported a 1998 Searay 210BR driven by a 19-year-old Tekamah, Nebraska, woman was anchored at the 31 mile marker of the Main Channel in the mouth of the Big Niangua arm at Lake of the Ozarks.

The driver put the boat in reverse to try to avoid a crash with another vessel.&nbsp; The anchor became dislodged and hit a 20-year-old male passenger from New Mexico in the head.

ELLIS COUNTY —Law enforcement in Ellis County provided additional details into the arrest of a suspect wanted for shooting a Lee's Summit, Missouri Police officer.

Just after 2a.m. Tuesday the Ellis Police Department received a tip via CrimeStoppers that the suspect, identified as Thomas Tolbert, was staying at the Day’s Inn Hotel, located at 205 Washington Street in Ellis, according to a press release from the Ellis Police Department.

The Ellis Police officer on duty requested that the CrimeStoppers tip line get in contact with Ellis County Communications, in order to gather the most accurate information and broadcast it out to area law enforcement units. All available units were requested to respond to the city of Ellis so that a plan could be devised to verify the integrity of the tip that was received, the release said.

At about 2:42 a.m., Ellis County Communications received additional information from witnesses who reported giving Tolbert a ride from the Kansas City, Missouri area. They stated they were en route to Colorado and had been asked by a third party to transport Tolbert, unaware of his connection to the Blue Alert, the release said.

According to the witnesses, Tolbert provided a false name and began acting suspiciously during the trip. Upon stopping to rest for the night, one of the witnesses saw the Blue Alert on social media featuring Tolbert’s image and immediately contacted law enforcement, the Ellis release said.

At 2:45 a.m., the Ellis Police Department requested activation of the Hays Police Department’s Special Situation Response Team (SSRT). Members of the Kansas Bureau of Investigation also responded to the scene. At 4:39 a.m., SSRT began evacuating adjacent hotel rooms.

Officers from the Hays Police Department, deputies from the Ellis County Sheriff’s Office and KBI agents arrived at the hotel and safely took Tolbert into custody at around 4:50 a.m., the KBI said.

Tolbert was arrested on a Missouri warrant on requested charges of assault first-degree or attempted serious physical injury, armed criminal action, unlawful possession of a firearm, resisting arrest or detention by fleeing, and second-degree domestic assault.

New details released on NW Kan. arrest of police officer shooting suspect

WASHINGTON (AP) —Tech billionaire Elon Musk, who just left the Trump administration, blasted the Republican tax cuts and spending plans that passed the House.

“This massive, outrageous, pork-filled Congressional spending bill is a disgusting abomination,” Musk posted Tuesday on X. “Shame on those who voted for it: you know you did wrong. You know it.”

Musk continued that the bill “will massively increase the already gigantic budget deficit to $2.5 trillion (!!!) and burden America citizens with crushingly unsustainable debt.”

<a href="https://apnews.com/hub/elon-musk">Musk stepped down</a>&nbsp;last week from his role as head of the Department of Government Efficiency, which has been tasked with slashing federal spending.

White House press secretary Karoline Leavitt played down the criticism by one of Trump’s top advisers and funders of his political operations during last year’s election.

“The president already knows where Elon Musk stood on this bill,” Leavitt said, adding that Musk’s post “doesn’t change the president’s opinion.”

Senate majority leader pushes back on Musk critique of GOP bill

John Thune said billionaire Elon Musk’s critiques of the Republicans’ sweeping tax and spending package amounts to “a difference of opinion” and said the Senate would not change course.

“So we have a difference of opinion. He’s entitled to that opinion. We’re going to proceed full speed ahead,” Thune told reporters.

Thune said he has seen economic modeling that predicts “significant growth” in the U.S. economy if the proposals were enacted.

He said Musk’s concerns were based on analysis from the Congressional Budget Office that he called “static scoring assessment.”

He dismissed concerns that Musk’s critiques could tank the GOP’s signature legislation.

“We have an agenda that everybody campaigned on, most notably the president,” Thune said.

Johnson said he spoke with Musk on Monday for more than 20 minutes by telephone. He said he extolled the virtues of the bill and how it was achieving campaign promises while making permanent massive tax and spending cuts.

“It’s a very important first start. Elon is missing it,” Johnson said.

Johnson also noted how the bill quickly phases out tax credits for electric vehicle purchases.

“That is going away because the government should not be subsidizing these things,” Johnson said. “I know that&nbsp;<a href="https://apnews.com/article/musk-trump-tesla-starlink-spacex-twitter-x-robotaxi-selfdriving-austin-e5206c756299f47e81fb90fb4734661a">has an effect on his business</a>&nbsp;and I lament that.”

He also said that’s he’s surprised by Musk’s criticism given their conversation.

“I just deeply regret he’s made this mistake,” Johnson said.

TOPEKA —&nbsp;Governor Laura Kelly issued a verbal State Disaster Emergency for Kansas on Tuesday afternoon due to heavy rainfall causing flooding in areas of the state.

“Flood waters can be deceptive; and it only takes 18 inches of water to float a car,”&nbsp;Kelly&nbsp;said. “If you are traveling in areas with heavy rainfall, I encourage you to remember one simple phrase if there is water on the roadway: ‘Turn around, don’t drown.'”

This declaration enables the use of resources to provide state assistance.

Gov. issues state of disaster declaration for flooding in Kansas

SEDGWICK COUNTY — The Sedgwick County District Attorney's office announced Tuesday they will&nbsp; not file charges in a deadly 2024 officer-involved shooting in Haysville.

On March 26, 2024, the Wichita-Sedgwick County Advanced Law Enforcement Response Team (A.L.E.R.T) investigated a Haysville Police Department officer involved shooting that occurred in the 200 block of N. Main in Haysville Kansas, according to a statement from the district attorney's office.

Just before 5p.m. that day, officers of the Haysville Police Department were dispatched to the 200 block of N. Lamar for a welfare check where 68-year-old Bill Osterhout, Haysville resident, was reported to have been making suicidal statements. Osterhout was not located when the officers arrived on-scene.

At approximately 5:31 P.M. a Haysville Police Officer located Osterhout’s vehicle parked at a business in the 200 block of N. Main in Haysville. Osterhout was in his vehicle with a handgun. Several other officers responded to the scene. Osterhout made suicidal statements to the officers. Officers attempted to deescalate the situation without success. 

Osterhout pointed the handgun at himself several times while officers were speaking to him. At approximately 5:42 P.M., Osterhout pointed a handgun at two Haysville Police Officers. Two Haysville Police Officers fired their handguns striking Osterhout. Officers attempted lifesaving efforts until Sedgwick County Fire and EMS personnel arrived. Those efforts were unsuccessful and Osterhout was pronounced dead on-scene at 5:49 P.M.

An autopsy report indicated that Osterhout was shot 12 times, primarily in the neck and head areas. It also indicated the presence of ethanol in his system.

The officers were found justified in shooting Osterhout through the state's "stand your ground" law, according to the report.

As federal health officials vow to overhaul&nbsp;<a href="https://apnews.com/article/artificial-synthetic-food-dyes-natural-fda-sensient-ad9611b1235f2097469508e711e71094">the U.S. food supply</a>, they’re taking a new look at&nbsp;<a href="https://apnews.com/article/health-breastfeeding-1a666d5da95ef605b0a71c48c63e9461">infant formula</a>.

Health Secretary Robert F. Kennedy Jr. has directed the Food and Drug Administration to review the nutrients and other ingredients in infant formula, which fills the bottles of millions of American babies. The effort, dubbed “Operation Stork Speed," is the first deep look at the ingredients since 1998.

“The FDA will use all resources and authorities at its disposal to make sure infant formula products are safe and wholesome for the families and children who rely on them,” Kennedy said.

About three-quarters of U.S. infants&nbsp;<a href="https://apnews.com/article/covid-health-united-states-bdc079e51ae6241dce2f78533a055b3a">consume formula</a>&nbsp;during the first six months of life, with about 40% receiving it as their only source of nutrition, according to the Centers for Disease Control and Prevention.

Formula has been widely used in the U.S. for roughly six decades, feeding generations of infants who have flourished, said Dr. Steven Abrams, a University of Texas infant nutrition expert.

The broader scientific community has been calling for a reevaluation of infant formula for years and is “fully supportive of this idea of a comprehensive look,” he said.

Current formula products in the U.S. continue to be safe and nourishing, he said.

“But there’s been a lot of science and we want the FDA rules to align with the most recent science from around the world,” he said.

What is infant formula and why do so many babies consume it?

Infant formula is a manufactured product, usually made from cow’s milk or soy, that is intended to mimic human breast milk for kids up age 12 months. It may be the sole source of nutrition or supplement breastfeeding.

FDA regulations require that infant formulas contain 30 specific nutrients, with minimum levels for all and maximum levels for 10 of them.

The ingredients vary, but all formulas must have a balance of calories from protein, carbohydrates and fat that mirrors what's found in human milk.

<a href="https://www.cdc.gov/breastfeeding/php/guidelines-recommendations/index.html">Federal guidelines</a>&nbsp;recommend that babies be exclusively breastfed for the first six months of life and that parents continue breastfeeding for the first year or more while adding new foods to the child’s diet.

Parents use formula when a mother cannot or chooses not to breastfeed for a wide range of reasons, including medical conditions, work conflicts, to allow other family members to help with feedings and other situations.

Why is the government reviewing baby formula now?

Kennedy announced the review of infant formula in March as part of his “Make America Healthy Again” agenda for the U.S. food supply.

The FDA’s review will include increased testing for heavy metals and other contaminants as well as a review of nutrients, the agencies said.

U.S. health officials will hold a two-hour&nbsp;<a href="https://www.fda.gov/patients/fda-expert-panels/fda-expert-panel-infant-formula-06042025#event-information">roundtable discussion</a>&nbsp;of infant formula on Wednesday.

The FDA is asking for new scientific data and information about whether required ingredients in infant formula should be added, removed or changed. The deadline for comments is Sept. 11.

Scientists say a review is long overdue regarding the most recent data on the composition of human milk and how babies digest and absorb nutrients in breastmilk and formula.

In addition, they want the FDA to consider how U.S. formulas compare with those made elsewhere, said Bridget Young, who studies infant nutrition at the University of Rochester.

“How do our regulations differ?” she said. “Maybe it’s time for them to relook at their regulations and consider potential international harmonization.”

More international alignment might have eased the&nbsp;<a href="https://apnews.com/article/science-health-government-and-politics-1e54ff345ab2a4be93f2e24d991e4450">U.S. infant formula crisis in 2022</a>, when contamination shut down an Abbott factory, leading to monthslong shortages for American parents, Young said.

In recent years, some parents have sought out infant formula made in Europe with the belief that products made overseas are healthier options, experts said.

Formula regulations in the U.S. and Europe, including requirements for nutrients and testing, differ somewhat, but are generally similar, Abrams said.

“The differences between the U.S. and Europe should not be considered as ‘higher’ or ‘better’ or ‘greater’ in one vs. the other,” he said.

Still, iron, for instance, is included at higher levels in U.S. formulas than in those in Europe — and Abrams suggested that U.S. officials may consider lowering iron targets.

Other components have been added to formula in recent years. They include docosahexaenoic acid, or DHA, an essential omega-3 fatty acid, and human milk oligosaccharides, complex sugars that are found breast milk but not in cow's milk. Although they may be beneficial, they are not required.

“These have been added to some formulas, but not to other formulas, so we want to take a look,” Abrams explained.

Many parents have raised concerns over formula ingredients such as added sugars and&nbsp;<a href="https://apnews.com/article/seed-oil-beef-tallow-kennedy-4fdf0f30134277fd6dd20b4ede789295">seed oils</a>, which are also being targeted by Kennedy as hazards in the wider food supply.

Recent research suggests that added sugars such as glucose and corn syrup solids in infant formula may be linked to weight gain in children. Young said that most experts agree that lactose, the primary type of sugar found in breast milk, is preferred.

Infant formulas in the U.S. do contain seed oils, Young said. But that’s because there are a finite number of vegetable oils that provide the essential saturated and unsaturated fats that babies require.

“They need to provide the variety of fatty acids that you see in breast milk,” she said.

Done properly, the FDA’s infant formula review would take “at least a year,” Abrams said. And it will require broad input from multiple government agencies, formula manufacturers and consumers.

“No shortcuts are possible and no one review, white paper or even committee report will suffice to do it right,” he said.

Kennedy Jr. has directed the Food and Drug Administration to review the nutrients and other ingredients in infant formula, which fills the bottles of millions of American babies. The effort, dubbed “Operation Stork Speed," is the first deep look at the ingredients since 1998.“The FDA will use all resources and authorities at its disposal to make sure infant formula products are safe and wholesome for the families and children who rely on them,” Kennedy said.About three-quarters of U.S. infants&nbsp;<a href="https://apnews.com/article/covid-health-united-states-bdc079e51ae6241dce2f78533a055b3a">consume formula</a>&nbsp;during the first six months of life, with about 40% receiving it as their only source of nutrition, according to the Centers for Disease Control and Prevention.Formula has been widely used in the U.S. for roughly six decades, feeding generations of infants who have flourished, said Dr. Steven Abrams, a University of Texas infant nutrition expert.The broader scientific community has been calling for a reevaluation of infant formula for years and is “fully supportive of this idea of a comprehensive look,” he said.Current formula products in the U.S. continue to be safe and nourishing, he said.“But there’s been a lot of science and we want the FDA rules to align with the most recent science from around the world,” he said.Here’s what you need to know about Operation Stork Speed:<h2>What is infant formula and why do so many babies consume it?</h2>Infant formula is a manufactured product, usually made from cow’s milk or soy, that is intended to mimic human breast milk for kids up age 12 months. It may be the sole source of nutrition or supplement breastfeeding.FDA regulations require that infant formulas contain 30 specific nutrients, with minimum levels for all and maximum levels for 10 of them.The ingredients vary, but all formulas must have a balance of calories from protein, carbohydrates and fat that mirrors what's found in human milk.<a href="https://www.cdc.gov/breastfeeding/php/guidelines-recommendations/index.html">Federal guidelines</a>&nbsp;recommend that babies be exclusively breastfed for the first six months of life and that parents continue breastfeeding for the first year or more while adding new foods to the child’s diet.Parents use formula when a mother cannot or chooses not to breastfeed for a wide range of reasons, including medical conditions, work conflicts, to allow other family members to help with feedings and other situations.<h2>Why is the government reviewing baby formula now?</h2>Kennedy announced the review of infant formula in March as part of his “Make America Healthy Again” agenda for the U.S. food supply.The FDA’s review will include increased testing for heavy metals and other contaminants as well as a review of nutrients, the agencies said.U.S. health officials will hold a two-hour&nbsp;<a href="https://www.fda.gov/patients/fda-expert-panels/fda-expert-panel-infant-formula-06042025#event-information">roundtable discussion</a>&nbsp;of infant formula on Wednesday.<h2>What issues will that cover?</h2>The FDA is asking for new scientific data and information about whether required ingredients in infant formula should be added, removed or changed. The deadline for comments is Sept. 11.Scientists say a review is long overdue regarding the most recent data on the composition of human milk and how babies digest and absorb nutrients in breastmilk and formula.In addition, they want the FDA to consider how U.S. formulas compare with those made elsewhere, said Bridget Young, who studies infant nutrition at the University of Rochester.“How do our regulations differ?” she said. “Maybe it’s time for them to relook at their regulations and consider potential international harmonization.”More international alignment might have eased the&nbsp;<a href="https://apnews.com/article/science-health-government-and-politics-1e54ff345ab2a4be93f2e24d991e4450">U.S. infant formula crisis in 2022</a>, when contamination shut down an Abbott factory, leading to monthslong shortages for American parents, Young said.<h2>What about specific ingredients?</h2>In recent years, some parents have sought out infant formula made in Europe with the belief that products made overseas are healthier options, experts said.Formula regulations in the U.S. and Europe, including requirements for nutrients and testing, differ somewhat, but are generally similar, Abrams said.“The differences between the U.S. and Europe should not be considered as ‘higher’ or ‘better’ or ‘greater’ in one vs. the other,” he said.Still, iron, for instance, is included at higher levels in U.S. formulas than in those in Europe — and Abrams suggested that U.S. officials may consider lowering iron targets.Other components have been added to formula in recent years. They include docosahexaenoic acid, or DHA, an essential omega-3 fatty acid, and human milk oligosaccharides, complex sugars that are found breast milk but not in cow's milk. Although they may be beneficial, they are not required.“These have been added to some formulas, but not to other formulas, so we want to take a look,” Abrams explained.Many parents have raised concerns over formula ingredients such as added sugars and&nbsp;<a href="https://apnews.com/article/seed-oil-beef-tallow-kennedy-4fdf0f30134277fd6dd20b4ede789295">seed oils</a>, which are also being targeted by Kennedy as hazards in the wider food supply.Recent research suggests that added sugars such as glucose and corn syrup solids in infant formula may be linked to weight gain in children. Young said that most experts agree that lactose, the primary type of sugar found in breast milk, is preferred.Infant formulas in the U.S. do contain seed oils, Young said. But that’s because there are a finite number of vegetable oils that provide the essential saturated and unsaturated fats that babies require.“They need to provide the variety of fatty acids that you see in breast milk,” she said.<h2>What are the next steps?</h2>Done properly, the FDA’s infant formula review would take “at least a year,” Abrams said. TOPEKA — The Trump administration has paused its demand for the personal data of Supplemental Nutrition Assistance Program recipients after a lawsuit was filed May 22 by national advocacy organizations.

Kansas Department for Children and Families officials received a letter from the U.S. Department of Agriculture in early May demanding personal information about SNAP recipients in the state.&nbsp;<a href="https://kansasreflector.com/2025/05/22/kansas-denies-usda-request-for-personal-data-of-residents-receiving-food-assistance/">DCF refused to send the data</a>, stating, “At this time, we are unsure as to the reason for the USDA’s request.”

A motion for a temporary restraining order was filed May 27 by counsel for the National Center for Law and Economic Justice, the National Student Legal Defense Network, Protect Democracy Project, the Electronic Privacy Information Center and MAZON: A Jewish Response to Hunger. The same group also filed the lawsuit challenging USDA’s access to the protected information, a news release said.

In a sworn declaration, USDA official Shiela Corley said the agency has not collected SNAP recipient data after telling the third-party vendors that maintain the data to hold off on submitting it, the news release said.

“USDA has instructed EBT Processors to refrain from sending any data until USDA completed procedural steps to ensure that data received would be appropriately safeguarded and to satisfy all necessary legal requirements,”&nbsp;<a href="https://www.defendstudents.org/news/body/2025.05.30-Dkt-11-1-Corley-Decl..pdf" target="_blank">her testimony said</a>. “In accordance with USDA’s instruction, EBT Processors have not sent any data to USDA in response to the May 6 letter. Before any of the data described in the May 6 Letter is provided to USDA, USDA intends to publish a new SORN (System of Records Notice) in compliance with the Privacy Act.”

Although Corley’s declaration caused the advocacy organizations to drop the motion for the restraining order, the lawsuit will continue, the press release said.

“This is a victory for tens of millions of SNAP recipients and anyone who cares about protecting our personal data against government abuse,” John Davisson, an EPIC official, said in the release. “Although this fight is just beginning, we’re grateful that the USDA acknowledged its legal obligation to safeguard privacy and remain accountable to the public.”

Abby J. Leibman, president and CEO of MAZON, said in the news release that the USDA must consider how its actions affect those facing hunger in the United States.

“The laws and processes protecting privacy exist for vital reasons. Americans are clear that everyone has a high expectation of privacy regarding their personal information — and SNAP applicants do not cede that expectation in exchange for receiving vital support to meet their basic needs,” she said.

SEDGWICK COUNTY —Law enforcement are investigating a fatal shooting that occurred early Tuesday morning at a gas station in northeast Wichita.

At 3:13 a.m., officers were dispatched to the Valero gas and convenience store, 2011 E. 21st Street in Wichita, according to police spokesman Andrew Ford. Upon their arrival, they found 33-year-old Darries Mitchell of Wichita suffering from gunshot wounds.

Police have not reported an arrest or additional details.

SHAWNEE COUNTY —Law enforcement authorities investigating a fatal shooting that occurred in 2022 have arrested a suspect for a second time.

On Monday, as a result of the ongoing investigation, Kayden Smith, 22, of Topeka, was transported to the Shawnee County Department of Corrections on the requested charge of 2nd Degree Murder.

Just after 11:p.m. April 22, 2022, police were dispatched to the 500 Block of SW Lane in reference to a shooting. First responders found one victim identified as 35-year-old Dustin Michael Clayton of Topeka, suffering from a gunshot wound. He was pronounced deceased at the scene.

At the time, following a two week investigation and a collaborative effort with the U.S. Marshal Service and the Kansas Highway Patrol, police arrested Smith on a requested charge of Murder in the 1st Degree.&nbsp; He is&nbsp; being held without bond, according to online jail records.

The opening of the&nbsp;<a href="https://missouriindependent.com/2025/05/27/missouri-governor-calls-special-session-for-kansas-city-stadiums-st-louis-disaster-funding/">legislative special session Monday</a>&nbsp;put partisan and intraparty fights in the Missouri Senate on display as Democrats called for expanded storm relief and Freedom Caucus members called for tax cuts as the price for supporting stadium subsidies.

Gov. Mike Kehoe called lawmakers together just two weeks after they finished work in the regular session to consider a package of tax incentives intended to convince the Kansas City Chiefs and Royals to stay in Missouri.&nbsp;

Kehoe is also asking lawmakers for a $235 million spending bill with $25 million for disaster relief as well as a special tax deduction for the cost of meeting insurance deductibles after a disaster.&nbsp;

The brief opening session didn’t feature any sharp exchanges, but the bills filed — and the statements made about them — show where the battle lines are being drawn.

Senate Minority Leader Doug Beck, a Democrat from Affton, told reporters that members of his caucus aren’t willing to talk about stadium funding until an appropriations bill and other disaster relief measures are on Kehoe’s desk.

“When that happens and it’s through the House and on the governor’s desk, then we can talk about it,” Beck said.

Members of the Freedom Caucus said they are holding out for a tax cut that benefits all Missourians before considering a stadium plan, said state Sen. Nick Schroer, a Republican from Defiance.

Schroer filed a bill to cut the top income tax rate to 4% — it is currently 4.7% — and make the tax flat across all incomes.

“​​The members of the Freedom Caucus, plus the other conservative members that are not necessarily in the caucus, they’ve all expressed that whether it’s income tax, personal property tax or real property tax, for us to sit at the table, and allow tax credits for billionaires to move forward, the little guy needs to get something in return,” Schroer said.

The regular session ended in acrimony when Republicans twice invoked a rarely used procedural move to shut off debate. Democrats had blocked a proposed ballot measure to restore Missouri’s ban on most abortions and a bill repealing the paid sick leave law passed by voters in November.

Democrats vowed that the move ended their cooperation with Republicans and gave a taste of what that meant last week when they&nbsp;<a href="https://missouriindependent.com/2025/05/29/bipartisan-resistance-building-against-missouri-governors-stadium-funding-plan/">stalled the final paperwork</a>&nbsp;of the regular session.

Kehoe hopes to have his plan for tax incentives worth about 50% of the cost of new or renovated stadiums to be passed by then.The plan for the Chiefs and Royals would take tax money already generated from activities at the stadiums — $28.8 million annually as estimated by the Chiefs and $15 million annually by an estimate from the Royals — and commit it to bond payments for 30 years for the new or upgraded facilities.The economic activity associated with the Chiefs supports 4,500 jobs, Kehoe contends, and a new stadium for the Royals would generate about 8,400 jobs.&nbsp;The spending bill Kehoe wants passed would use $25 million of general revenue to support a new research reactor on the University of Missouri’s Columbia campus, plus funding for a new livestock display barn at the State Fairgrounds in Sedalia and about $50 million to help with construction of a new mental hospital in Kansas City.The funding for the reactor is $25 million less than Kehoe proposed. State Sen. Stephen Webber, a Columbia Democrat, introduced an appropriations bill with $75 million for the reactor, plus all the other general revenue projects that died when Missouri House Republicans refused to bring the construction spending bill up for a vote.“If there is going to be a $25 million variance on agreements made in this chamber, we ought to go $25 million in the other direction,” Webber said.Webber also introduced a bill imposing a 1% income tax surcharge on incomes greater than $1 million, which he said would bring in about $400 million over three years to support disaster relief.“There is obviously a belief, among some, that billionaires should be given a sweetheart deal. I would disagree with that,” Webber said. “There is also some concern about whether we can fund disaster relief for some communities in our state that were desperately hit. So what I’ve tried to do is build a bridge between those two issues.”State Sen. Rick Brattin, a Harrisonville Republican who chairs the Freedom Caucus, introduced a bill to finance the stadiums entirely from donations. He called it the “No Taxation, All Donation Act” and included incentives for giving.“So if somebody gives over $10,000 to this stadium, then they are able to obtain free parking to be able to get into that stadium,” Brattin said.The next step will be to send the bills to committees for hearings.
