COWLEY COUNTY —Law enforcement authorities continue working to identify the driver in a fatal accident that occurred just after 11p.m. Saturday Feb. 18, in Cowley County.

The Kansas Highway Patrol reported a 1995 Chevy Camaro was eastbound on 33rd Avenue at Meadowlark in Winfield. The car crossed the centerline, left the roadway, rolled and struck a telephone pole.

A passenger in the car identified as Nicholas R. Morris, 27, Arkansas City, was pronounced dead at the scene and transported Miles Mortuary. The driver of the vehicle fled the scene of the accident.&nbsp; 

Authorities are waiting for additional evidence to confirm the identity of the driver, according to the KHP.&nbsp;&nbsp;

KHP continues work to ID driver in fatal Kansas crash

KANSAS CITY– A former Kansas City man who moved to Mexico and lived under another name, has been indicted by a federal grand jury on charges related to producing child pornography.

Wyatt Christopher Maxwell, also known as “Louis Whitaker,” 23, was charged in a five-count indictment returned under seal by a federal grand jury in Kansas City on Feb. 7, 2023, according to the United State's Attorney.

 That indictment has been unsealed and made public upon Maxwell’s arrest in Mexico on Feb. 14, 2023, and initial court appearance in the Central District of California (in Los Angeles, Calif.) on Feb. 16, 2023.

Maxwell lived in Kansas City at the time of the alleged offenses, but afterward moved to Puerto Vallarta, Mexico, where he went by the name “Louis Whitaker” as a cabaret singer.

The federal indictment alleges that Maxwell used a minor victim to produce child pornography between July 31, 2020, and Feb. 1, 2021. The indictment also alleges that Maxwell transported the minor victim across state lines from Kansas to Missouri to engage in illegal sexual activity.

Maxwell is also charged with two counts of distributing child pornography over the internet and one count of possessing child pornography.

Indictment: KC child porn suspect moved to Mexico, changed name

SHAWNEE COUNTY —Law enforcement authorities are investigating a suspect on multiple charges after an overnight arrest.

Just before 12:30a.m. Sunday, police were dispatched to the 1900 block of SE Washington in Topeka for an alleged aggravated assault, according to Police Sgt. Jake Cobbler. 

Upon officers arriving in the area a subject wanted in connection to the assault was located and stopped in a traffic stop. Officers made contact with 38-year-old Julian Everett who initiated several short low speed vehicle pursuits and eventually stopped in the 1200 block of SE Washington in Topeka. Everett told officers he had a firearm.

TPD’s Response Team and Crisis Negotiators responded to the scene and attempted to make contact with Everett.

Just after 3a.m. police took Everett into custody without incident and

transported him to the Shawnee County Department of Corrections on requested charges of Aggravated Assault, Felony Flee and attempt to Elude Law Enforcement Officer, Interference with Law Enforcement Officer and Multiple Traffic Offenses.

Police arrest Kansas assault suspect after standoff

Two years after federal rules first required hospitals to tell you 
what they’re charging for different services, one report suggests only 
15% of Kansas hospitals hit the mark.

The consumer group Patient Rights Advocate’s <a href="https://www.patientrightsadvocate.org/february-semi-annual-compliance-report-2023" target="_blank">February report </a>found
 three of the 20 hospital systems that it reviews in the state — the 
organization focused on the largest hospital systems — fully comply with
 the federal price transparency rule. The group said several on the list
 were partially complying.

“We can count on what milk is going to 
be charged, or even eggs. We know eggs have gone up because of supply 
and demand. But we will know what those prices are,” Patient Rights 
Advocate founder Cynthia Fisher said. “It’s not like you find out what 
the dozen eggs costs, weeks or months later, and it’s 100 times more 
than you would have ever expected.”

The group’s report reviewed 2,000 hospitals nationwide and focused on
 the larger health systems in the country. The national rate of 25% of 
hospitals in compliance, by the group’s accounting, is almost double 
what it found in Kansas.

“We applaud those hospitals that are 
fully posting all of their prices,” Fisher said. “However, that shows 
you that the other largest hospitals in Kansas are flouting the law.”

The
 report strongly conflicts with a more limited sampling conducted by the
 federal Centers for Medicare and Medicaid Services. The government 
agency released a <a href="https://www.healthaffairs.org/content/forefront/hospital-price-transparency-progress-and-commitment-achieving-its-potential" target="_blank">report this month</a>
 that said 70% of the 600 hospitals it reviewed met the website 
assessment criteria. They include machine-readable files and 
consumer-friendly displays such as a price estimate tool. That marked a 
27% improvement from what CMS found a year ago.

The Patients Right
 Advocate report shows that Centura Health, which runs two St. Catherine
 hospital locations in western Kansas, did not live up to the federal 
rules. That hospital group challenged the findings.

“We encourage 
our patients to request a patient-specific price estimate to help them 
determine their costs,” the organization said in a statement. 
“Additionally, Centura Health and our 19 hospitals are compliant with 
federal law regarding price transparency.”

Mercy Hospital in 
Columbus, Kansas, was also listed as non-compliant. But officials there 
say they have met all the CMS requirements.

“CMS determines 
hospitals’ compliance with these regulations, and while political groups
 continue to ask for new rules and regulation, they don't set the 
requirements,” a hospital spokesperson said in a statement. “We stand by
 our transparency efforts, which are supported by the fact we acted 
quickly to correct a single request raised by CMS in 2021. We would do 
the same if CMS had other concerns.”

Turquoise Health collects 
data from hospitals and grades them on price transparency. It scores 
Centura’s St. Catherine-Garden City hospital five out of five stars and 
Mercy Hospital in Columbus two out of five stars on compliance. 
Centura’s St. Catherine-Dodge City does not have a scorecard.

Even when hospitals make the numbers available, they often do so in confusing ways. A <a href="https://www.healthsystemtracker.org/brief/ongoing-challenges-with-hospital-price-transparency/" target="_blank">recent analysis</a>
 by the Kaiser Family Foundation found that hospitals are inconsistent 
with where the price transparency data is located on the website and how
 the files are organized.

“Even if there was a specific condition 
that the patient’s trying to price shop on, there’s a lot of times key 
information missing in the data,” co-author Krutika Amin said. “And when
 the data is available for the patient, it might be difficult to figure 
out what all different pieces go into the service that they’re seeking.”

Amin
 said to get a true estimate one might have to combine different costs 
that would be bundled in a medical bill but are listed individually 
online.

“It might take some maneuvering for even an expert to cobble together the pieces that make up the costs for care,” she said.

Missing codes also can make it difficult to know the difference in charges between inpatient and outpatient settings, Amin said.

Fisher,
 the Patient Rights Advocate founder, said CMS needs to enforce its 
rules more aggressively. The federal agency has sent warning letters to 
about 500 hospitals, but it has only fined two hospitals — both in 
Georgia in 2022. The two became compliant after they were fined.

Starting
 this year, the Biden Administration increased possible fines for 
failing to comply. They range from $300 to $5,500 per day.

Fisher said the first step in addressing high health care costs is making hospitals reveal prices easily readable by consumers.

“The
 only way we can get there is to be able to see the wide variety of 
prices that there are now and to comparatively see what's happening 
across the state of Kansas on pricing,” she said, “and how that compares
 to adjacent states.”

Despite rule, still hard to comparison shop hospital care in Kansas

DODGE CITY — How do you turn kindergartners into wranglers?

“Little bitty saddles,” Melissa Vander Hamm said, “for little bitty kids.”

There’s
 a bit more to youth rodeo than that. You need your own horse. Plus a 
trailer to haul the horse and a truck to tow it all. To ride, you’ll 
need one of those little saddles and a bunch of other tack, which could 
put you back thousands of dollars.

In all, a youth rodeo family is an extensive, expensive commitment to living the rural Western lifestyle.

But
 Vander Hamm knows all that. She’s been competing in rodeo since she was
 nine years old. Her two sons started at age five. Now, she helps run 
the <a href="http://younggunsdc.com/" target="_blank">Young Guns Extravaganza</a>, a youth rodeo series in Dodge City.

“It’s
 not a cheap hobby,” Vander Hamm said. “Drive through our parking lot on
 rodeo weekend and the amount of money just in pickups and trailers … 
it’s crazy.”

For rodeo families — most of whom, she said, come from agricultural 
backgrounds — the cost of competing is worth every penny as they look 
for ways to sustain their traditional way of life and their town’s 
population of young folks.

In a place where farms and ranches go 
back generations, rodeo is sewn deep into the cultural fabric of rural 
Kansas. But the number of people living in the region’s small towns has 
been shrinking for decades as young adults leave the rural life for 
bigger cities. Most counties in western Kansas have been <a href="https://ipsr.ku.edu/ksdata/ksah/population/popmax.pdf" target="_blank">steadily emptying</a> since the Dust Bowl.

And
 parents like Vander Hamm, who lives in the neighboring town of Ingalls 
(population 288), hope that introducing more kids to the rodeo world 
might spur them to fall in love with their hometowns’ cowboy culture. 
Then maybe when those kids grow up, they’ll want to get back in the 
saddle again.

“The ones that do love it,” Vander Hamm said, “are inclined to come back and be part of the family farm.”

Despite any financial barriers to getting started, youth rodeo is growing.

Vander
 Hamm founded Young Guns in 2014 with a few other parents who wanted 
their kids to get more practice during the winter, when other 
competitions shut down.

The first year, she expected around 50 kids to show up. She got 120.

This
 season, Young Guns has welcomed nearly 400 little cowpokes into the 
arena, as they dummy rope, pole bend or barrel race their way to glory. 
And it’s just one of several <a href="https://www.kjra.com/" target="_blank">youth</a> <a href="http://www.ckyra.com/" target="_blank">rodeo</a> <a href="https://www.heartlandyouthrodeo.com/" target="_blank">associations</a> across the state.

“I do think it’s a trend,” Vander Hamm said. “It’s a time when it’s cool to be a cowboy.”

On rodeo day, 
hundreds of horses trot through an expo center on the south edge of 
Dodge City. They kick up fine brown dust from the arena floor into 
clouds that hang in the air.

The morning starts with a prayer from
 the rodeo chaplain. Then comes the national anthem as the Miss Santa Fe
 Trail Queen gallops in with a flag.

Mesa Hedland stands near the 
arena entrance decked out in a brown Western shirt with leather tassels 
dangling from leopard print shoulder patches.

She’s waiting for 
her favorite event, which involves chasing down a goat and untying a 
ribbon from its tail, with help from her trusty steed named Ott.

“He’s addicted to me,” Hedland, who’s from Anthony, Kansas, said. “We can’t spend a day without hanging out with each other.”

Hedland is only five years old, but this is far from her first rodeo. She’s been chasing those goats since she was three.

In
 the horse warm-up area, nine-year-old friends Paisley Davis and Braylin
 Barratt offer a tour of the bridles and stirrups strapped to their 
four-hoofed friends. The pair live a few hours apart in southern 
Colorado, so they’re making up for lost time here.

Listening to them as they inspect their saddles and laugh about the 
odd things one particularly ravenous horse has eaten, it’s not hard to 
spot what rodeo families see as the upside of all this and what they 
hope kids take away from the experience.

The hard work it takes to
 care for an animal 10 times their size. The hours of practice required 
to master skills that most adults can’t pull off. The grit they need to 
ride into the arena — where every kid but one ends up leaving a loser.

“Be grateful that even though you didn’t win, someone else won,” Barratt said. “Always be grateful.”

And the bonds they form — with people and animals — along the way.

Davis
 walks up to her horse Thunder until the two stand eye-to-eye. She rests
 her hand on his neck near the black mane that she’s carefully woven 
into braids.

“When you do have a bad day,” Davis said, “you can just talk to your horse about it.”

Gene Theodori, a 
sociology professor at Sam Houston State University in Texas, isn’t 
surprised to see events like Young Guns growing. Rodeo’s enduring 
appeal, he said, comes back to the idea that rural America is the last 
remnant of a bygone, simpler lifestyle.

He calls it <a href="https://onlinelibrary.wiley.com/doi/abs/10.1111/ruso.12227" target="_blank">the rural mystique</a>. And rodeo is a picture of that in its purest form.

“Whether
 it’s real or not,” Theodori said, “in our minds, it represents that 
wholesome rural way of life. … And we, as a society, we yearn for that.”

What we’re seeing now, he said, is just the latest of many waves of 
interest in old-time Western culture that have washed over American 
society, especially as the country’s become more suburban and urban.

In
 the 1950s and 1960s, there was a surge of interest captured by the 
popularity of cowboy songs from Marty Robbins and Roy Rogers and 
big-screen Westerns starring John Wayne and Clint Eastwood.

Now, 
the Old West has come back again in a big way. Theodori describes the 
current wave as the “Yellowstone” effect, in reference to the TV show 
about a powerful Montana ranching family that’s become the <a href="https://deadline.com/2022/11/yellowstone-premiere-was-most-watched-show-across-all-of-tv-this-year-1235176427/" target="_blank">most-watched drama</a> on television.

And
 he predicts that the “Yellowstone” effect could drive a spike in people
 from all walks of life wearing more cowboy hats, boots and 
Western-style dresses in the coming years.

“It’s perpetuating. It’s continuing,” Theodori said. “And truthfully, I don’t think it’s going to stop anytime soon.”

The sport of rodeo was born from genuine cowboy work. After long 
cattle drives, men from competing ranches would get together to one-up 
each other and see who’s the best. It would have been common, Theodori 
said, to see folks compete to rope a steer or ride a bronco after 
driving livestock up the <a href="https://en.wikipedia.org/wiki/Great_Western_Cattle_Trail" target="_blank">Great Western Cattle Trail</a> that passed through Dodge City in the late 1800s.

But what started out as a pastime for tough guys on the range has <a href="https://oaktrust.library.tamu.edu/handle/1969.1/ETD-TAMU-1996-THESIS-T464" target="_blank">become big business</a> all over the country.

A nationwide youth rodeo organization called the <a href="https://www.nlbra.com/" target="_blank">National Little Britches Rodeo Association</a> fielded more than <a href="https://cdn.saffire.com/files.ashx?t=fg&amp;rid=NLBRA&amp;f=Update_from_National_Office_Dec_2022(1).pdf" target="_blank">1,400 competitors</a> in 2022 and paid out nearly $275,000 in prizes.

There are now adult rodeo associations that cater specifically to <a href="https://www.wpra.com/" target="_blank">women</a>, <a href="https://bpcca.com/" target="_blank">Black Americans</a>, <a href="https://www.aircarodeo.com/" target="_blank">Native Americans</a> and <a href="https://www.igra.com/" target="_blank">LGBTQ</a> folks, too.

“The
 idea (is) that this is one way we can preserve our Western heritage,” 
Theodori, who competed in high school and college rodeo, said. “To me, 
that ties directly back to the rural mystique.”

The number of fifth-grade to 12th-grade kids competing in the <a href="https://www.khsra.net/" target="_blank">Kansas High School and Junior High School Rodeo Association</a> has jumped more than 15% in the past few years.

Suzan
 Adams, the association’s secretary, said she hears similar stories of 
growth when she talks with her counterparts across the country.

“It’s not just a Kansas thing,” Adams said. “It’s all over.”

Particularly
 since the COVID-19 pandemic began, she said, rodeo numbers have surged.
 She attributes it to people seeking a sense of normalcy in old-time 
activities and looking for a way to spend more time together as a 
family. Unlike other traveling sports, such as baseball or soccer, the 
rodeo family represents the athlete, the team and the coach all rolled 
into one.

It’s not only small-town kids who are saddling up, either. The 
competitions, Adams said, bring in folks from all over the state, 
including the Kansas City and Wichita metros. Some families even choose 
to tow their horse trailers in from parts of Colorado, Nebraska and 
Oklahoma to compete in the Kansas association’s season, which runs for 
11 weekends.

“It’s a huge investment,” Adams said. “I can’t think of anything that would be more expensive to do.”

It
 pays off in the end, she said. Her own son, a college freshman away on a
 rodeo scholarship, tells her he can’t wait to come back and work on the
 family ranch. His experience growing up on the youth rodeo circuit, she
 said, paved the way for that.

But it takes more than just rodeo parents to keep a large event like Young Guns running.

Mike Heiland doesn’t have kids, but he’s volunteered on the event’s board since the beginning. 

Over
 the course of one morning at the arena, he goes from driving the 
tractor that smooths the dirt floor for barrel racing to manning the 
metal gate that releases the calves for older kids to chase with lassos.

There’s been a groundswell of support from the Dodge City community, too.

Thanks
 to money from local businesses — who pay to have their logos hung from 
arena banners and their company names proclaimed from the announcer 
stand — Young Guns doesn’t have to charge kids a fee to enter the 
competition. And this season, this one rodeo has given out 42 saddles 
and nearly $200,000 in cash prizes to its champion buckaroos.

That,
 Heiland said, helps explain why the rodeo’s army of volunteers keeps 
showing up year after year, even when competition days can run from 8:00
 am to 10:30 pm.

“If you’ve ever stood on stage and handed a 
$2,000 saddle to a six-year-old and watched his eyes (or) her eyes get 
big,” Heiland said. “That’s a pretty cool deal.”

Even with renewed interest in 
rodeo’s Western ideals, rural Kansas faces a host of challenges as it 
looks toward the future. Namely, people keep leaving.

<a href="https://ipsr.ku.edu/ksdata/ksah/population/popmax.pdf" target="_blank">Two-thirds of Kansas counties</a>
 saw their populations peak prior to 1950. Roughly one-fourth of the 
state’s counties have been steadily losing residents since 1900.

Donna
 Ginther, who leads the Institute for Policy and Social Research at the 
University of Kansas, said the climate shock of the 1930s Dust Bowl was 
soon followed by a technology shock when automation — bigger tractors 
and combines that could do the work of many farm hands — began to gain a
 foothold after World War II.

That dynamic has only accelerated in the years since — John Deere recently revealed its plan for a <a href="https://www.deere.com/en/news/all-news/autonomous-tractor-reveal/" target="_blank">fully autonomous tractor</a> that doesn’t even need a farmer to sit in the cab driving it.

“Historically,
 agriculture is the victim of its own success,” Ginther said. “That has a
 negative impact on population growth in agricultural-dependent 
communities.”

Looking forward, <a href="https://www.hppr.org/hppr-news/2021-05-05/farmers-trying-to-save-the-ogallala-aquifer-face-tension-from-peers-but-their-profits-are-improving" target="_blank">dwindling underground water supplies</a> could perpetuate this trend. As wells run dry and more farms convert from <a href="https://www.hppr.org/hppr-news/2023-01-10/this-is-do-or-die-western-kansas-farmers-push-to-save-the-ogallala-aquifer-before-its-too-late" target="_blank">irrigated to dryland fields</a>, that could mean fewer people tending the land and working in agriculture businesses in town.

And
 even though a few parts of Kansas — mostly those attached to big metro 
areas or the southwest Kansas meatpacking centers — continue to grow, 
the state as a whole is falling behind nearly all of its neighbors. In 
the 2020 census, the populations in Nebraska, Iowa, Oklahoma and 
Colorado <a href="https://www.census.gov/library/stories/state-by-state.html" target="_blank">all grew faster</a> than Kansas.

Kansas is <a href="https://acl.gov/sites/default/files/programs/2016-11/Kansas.pdf" target="_blank">getting older</a>, too. The median age in <a href="https://www.census.gov/library/visualizations/2022/comm/aging-nation-median-age.html" target="_blank">roughly half</a> of the counties in western Kansas is now higher than the national average. The U.S. Census Bureau predicts that <a href="https://acl.gov/sites/default/files/programs/2016-11/Kansas.pdf" target="_blank">nearly a quarter</a> of Kansans will be over the age of 60 by 2030 — an increase of 32% since 2012.

Ginther, who grew up on a farm in Wisconsin, said it’s understandable
 that some young people may want to leave agriculture. It remains a hard
 way of life, built on dangerous, financially risky work that often 
depends on meteorological events beyond your control.

But 
dwindling farm town populations lead to other inevitable losses that 
make it even tougher for those rural areas to claw their way back toward
 growth. Hospitals close. School districts consolidate. Grocery stores 
shut down.

And if there aren’t many other young families around, it might be hard for children there to spend much time with other kids.

“It
 can’t hurt, right?” Ginther said. “If you have a rodeo, if you have 
4-H, if you have FFA (Future Farmers of America), then the kids can get 
together and do things that they're interested in.”

While city slickers might get anxious seeing a five-year-old ride a 
full-size horse, serious injuries in youth rodeo are relatively rare.

Just ask the man known as the <a href="https://medschool.cuanschutz.edu/deans-office/cu-med-today/profilesarchives/rodeo-doctor-jason-stoneback" target="_blank">rodeo doctor</a>,
 Jason Stoneback. Before becoming the chief of orthopedic trauma at the 
University of Colorado hospital, Stoneback spent years as a champion 
bull rider. He’s seen his share of injuries — both his own and those 
that happen to other riders. He often stands near the arena at rodeo 
events as the doctor on-call.

But the rodeo of today, Stoneback 
said, is safer than it used to be. And the rate of injury among youth 
rodeo athletes, he said, is less than half that of their adult 
counterparts.

“While it is a dangerous sport,” Stoneback said, “fortunately the majority of injuries are not serious.”

Stoneback’s <a href="https://www.tandfonline.com/doi/abs/10.1080/15438627.2018.1439034" target="_blank">research</a>
 has shown that the most common injuries in youth rodeo timed events are
 sprains and strains (jamming an ankle or pulling a muscle), contusions 
(bruises from getting hit or falling) and concussions.

One <a href="https://www.researchgate.net/publication/50831902_Rodeo_Catastrophic_Injuries_and_Registry_Initial_Retrospective_and_Prospective_Report" target="_blank">study</a>
 from the Canadian Academy of Sport Medicine found that catastrophic 
injuries happen in youth rodeo at a rate of around 10 cases per 100,000 
runs, but that includes competitions with older teenagers riding bulls. 
For context, <a href="https://healthysportindex.com/report/safety-analysis-report/" target="_blank">research</a>
 from the Aspen Institute shows that similarly severe injuries in youth 
football and cheerleading occur at rates of 1.21 per 100,000 and 1.33 
per 100,000, respectively

It helps that the cowboys and cowgirls 
at events like Young Guns focus on activities that are inherently less 
dangerous than the pros.

Instead of clinging to a 1,500-pound bull, these kids are riding 
their own horses through a timed obstacle course, chasing goats or 
lassoing fake steer heads. The Dodge City rodeo, Vander Hamm of Young 
Guns said, also has an emergency medical technician on stand-by in the 
arena just in case.

And with safety measures like helmets, shin 
guards and protective vests becoming more common, rodeo doctor Stoneback
 said, the benefits — like learning the value of working hard and 
bouncing back from defeat — can outweigh the risks.

“It’s not just a sport,” Stoneback said. “It’s a way of life.”

Back in the Young Guns arena, Braylin Barratt — one of the 
nine-year-olds from Colorado — climbs onto the back of her speckled gray
 horse named Jesse.

She’s been competing for five years already, 
so she’s been bucked off before. Dragged, too. But nothing that kept her
 out of the saddle.

“I never want to quit rodeoing,” Barratt said, “I just want to teach my kids how to ride and train and be just like me.”

How youth rodeo might help keep a generation in rural Kansas

KANSAS CITY (AP) — The American Civil Liberties Union of Missouri and two state library associations are suing over&nbsp;<a href="https://apnews.com/article/science-entertainment-education-biology-missouri-0fdae848f82c26b67751662801dfe7c9">a new state law</a>&nbsp;that bans sexually explicit material from schools, saying it violates the rights of librarians and students.

The lawsuit filed Thursday contends that the Republican-backed law, which took effect in August, has caused Missouri school districts to remove hundreds of books from their shelves.

The ACLU, the Missouri Association of School Librarians and the Missouri Library Association are asking the Circuit Court in Kansas City to find the law unconstitutional or clarify how and when it applies.

The law was passed as&nbsp;<a href="https://apnews.com/hub/book-banning">challenges to the content of library books</a>&nbsp;— both in schools and public libraries — have&nbsp;<a href="https://apnews.com/article/libraries-american-library-association-book-banning-af7c9f312266b572c3dc189b1d109de4">increased across the country over the last two years.</a>

Missouri's Republican secretary of state, Jay Ashcroft, has&nbsp;<a href="https://apnews.com/article/missouri-columbia-government-and-politics-libraries-9902e50714e3ba7501829b628a88cc2d">proposed a rule</a>&nbsp;that would block public funding for libraries that make “inappropriate” books available to minors. The proposal has been widely condemned by librarians and free speech advocates.

In the latest lawsuit, the ACLU sued Jean Peters Baker in her role as the Jackson County prosecutor and on behalf of all county prosecutors in Missouri.

Michael Mansur, a spokesman for Baker's office, said Friday that they had not seen the lawsuit and couldn't comment.

Librarians and other school officials face up to a year in jail or a $2,000 fine for violating the policy, which makes it a crime to provide minors with sexually explicit visual material. Exceptions are provided for works of art, science classes and other educational courses.

The lawsuit also contends that librarians and others could violate the law regardless of whether the material is provided inside or outside of a school building or school hours.

As of November, about 300 titles had been banned from school libraries across the state, according to the lawsuit. Many of those books were written by or about minority or LGBTQ individuals, but they also include graphic novels, human anatomy books and Holocaust history books.

The law endangers not only school librarians but public and academic librarians who work with K-12 schools, Joe Kohlburn of the Missouri Library Association's Intellectual Freedom Committee said in a statement.

“Librarians have been undermined politically in this state for long enough, and the fear of prosecution is an ongoing issue for keeping qualified professionals in Missouri, as well as bringing new people into the profession,” he said.

The ACLU argues that the law violates educators' due process rights because it is unconstitutionally vague and allows government overreach. It also argues that the suit violates students' First Amendment rights.

The lawsuit notes that federal and state law already prohibits providing obscene and pornographic materials to minors, and that school boards approve procedures for choosing appropriate library materials.

“Extreme politicians in Jefferson City are using the government-knows-best model for legislation — in this case telling parents what their children can and can’t read at school and, in some cases, at home, while imposing criminal penalties on those who might disagree,” said Gillian Wilcox, deputy director for litigation for the ACLU of Missouri.

Melissa Corey, president of the Missouri Association of School Librarians, said one of the group's major concerns is not only removing books currently on the shelves, but the potential for “a chilling effect” on what books are purchased in the future.

ACLU, library groups sue over new school book law

Martin said they screamed and thanked God.

“I know my brother. He was smiling,” Martin said. “He was like, ‘June 1! June 1 I’m coming home!’”

Betts, 46, and his cousin, Celester McKinney, 52, alleged that former Kansas City, Kansas, detective Roger Golubski and another detective coerced their uncle into identifying them as the shooters in the death of 17-year-old Gregory Miller.

They sought a new trial but Judge Gunnar Sundby ruled in&nbsp;<a href="https://apnews.com/article/crime-kansas-city-indictments-c84e4b6c29649993571a8f6e0f6edb53">December</a>&nbsp;that the men did not prove their case, despite a “cloud of doubt” over Golubski.

Golubski, 70, now&nbsp;<a href="https://apnews.com/337f9df63faf6c5ff8d3d50623b902c2">faces</a>&nbsp;federal charges of kidnapping, sexual assault and sex trafficking.

McKinney had a parole hearing on February 16 and was told he’ll learn if he’s paroled within a month of that day, Martin said.

McKinney’s attorney, Sarah Swain, said she hopes Betts winning parole means that McKinney could be next.

“Either way, this is great news for Brian Betts,” she said.

Kan. man who claims he was set up to be released on parole soon

WASHINGTON (AP) — If you get health care coverage through&nbsp;<a href="https://www.medicaid.gov/medicaid/index.html">Medicaid</a>, you might be at&nbsp;<a href="https://apnews.com/article/health-covid-304d921beee43d29f1862cd4d6ab5297">risk of losing that coverage</a>&nbsp;over the next year.

Roughly 84 million people are covered by the government-sponsored program, which has grown by 20 million people since January 2020, just before the COVID-19 pandemic hit.

But as states begin checking everyone's eligibility for Medicaid for the first time in three years, as many as 14 million people could lose access to that health care coverage.

A look at why so many people may no longer qualify for the Medicaid program over the next year and what you need to know if you're one of those people who relies on the program.

At the beginning of the pandemic, the federal government prohibited states from kicking people off Medicaid, even if they were no longer eligible. Before the pandemic, people would regularly lose their Medicaid coverage if they started making too much money to qualify for the program, gained health care coverage through their employer or moved into a new state.

That all stopped once COVID-19 started spreading across the country.

Over the next year, states will be required to start checking the eligibility again of every person who is on Medicaid. People will have to fill out forms to verify their personal information, including address, income and household size.

That will vary depending on which state you live in; some states are moving faster than others to check eligibility. Arizona, Arkansas, Florida, Idaho, Iowa, New Hampshire, Ohio, Oklahoma and West Virginia are among the states that will begin removing ineligible Medicaid recipients as early as April.

Other states will start taking that step in May, June or July.

Not everyone will be removed from the program all at once. States plan to verify all recipients’ eligibility over periods of nine months to one year.

HOW WILL I BE NOTIFIED IF I’M LOSING COVERAGE?

If you rely on Medicaid for care, it’s important to update your contact information, including home address, phone number and email with the state from which you receive benefits.

States will mail a renewal form to your home. The federal government also requires states to contact you in another way -– by phone, text message or email –- to remind you to fill out the form.

Even if mailed notices reach the right address, they can be set aside and forgotten, said Kate McEvoy, executive director of the nonprofit National Association of Medicaid Directors.

“A text might just grab someone’s attention in a way that would be more accessible,” she said, noting that a quick message also may be less intimidating than a mailed notice.

Most states have already used texting for things such as reminding patients to get a COVID-19 vaccine or about upcoming doctor’s visits. But sending mass texts on Medicaid eligibility will be new, McEvoy said.

You will have at least 30 days to fill out the form. If you do not fill out the form, states will be able to remove you from Medicaid.

WHAT ARE MY OPTIONS IF I’M KICKED OFF MEDICAID?

Many people who will no longer qualify for Medicaid coverage can turn to the Affordable Care Act’s marketplace for coverage, where they’ll find health care coverage options that may cost less than $10 a month.

But the coverage available on the marketplace will still be vastly different from what’s offered through Medicaid. Out-of-pocket expenses and co-pays are often higher. Also, people will need to check if the insurance plans offered through the marketplace will still cover their doctors.

A special enrollment period will open for people who are unenrolled from Medicaid that will start on March 31 and last through July 31, 2024. People who lose Medicaid coverage will have up to 60 days to enroll after losing coverage, according to guidance the Centers for Medicare and Medicaid Services sent to states last month.

MY CHILDREN ARE ENROLLED IN MEDICAID. WHAT WILL HAPPEN TO THEIR COVERAGE?

More than half of U.S. children receive health care coverage through Medicaid or the&nbsp;<a href="https://www.healthcare.gov/medicaid-chip/childrens-health-insurance-program/">Children’s Health Insurance Program</a>.

Even if you receive a notice that you’re no longer eligible for Medicaid, it’s likely that your child still qualifies for the program or for health care coverage through CHIP, which covers children whose families make too much money qualify for Medicaid but don’t earn enough to afford private health insurance.

Between 80% and 90% percent of children will still be eligible for those programs, according to estimates from the Georgetown University Health Policy Institute’s Center for Children and Families.

“When a parent receives a message that they aren’t eligible anymore, they often assume their child is no longer eligible either,” said Joan Alker, the center’s executive director. “It’s more common to find that the parent is no longer eligible for Medicaid, but the child still is.”

TOPEKA — Elective politics newcomer Jeanna Repass won the race Saturday to take over as chairwoman of the Kansas Democratic Party in a close contest against former state Treasurer Lynn Rogers.

Repass, of Overland Park, stepped into the political arena in&nbsp;<a target="_blank" href="https://kansasreflector.com/briefs/johnson-county-democrat-running-for-kansas-secretary-of-state/">2022 with an unsuccessful campaign for Kansas secretary of state</a>. She lost the general election showdown in November by nearly 200,000 votes to incumbent Secretary of State Scott Schwab. There was subsequent criticism of Repass regarding an allegation she didn’t properly compensate one of her campaign workers.

Repass won the top party post by leveraging endorsements from Democratic Gov. Laura Kelly, U.S. Rep. Sharice Davids, Senate Minority Leader Dinah Sykes and House Minority Leader Vic Miller to secure 122 votes to Rogers’ 107. The recommendation by Kelly was particularly striking, because Rogers was elected lieutenant governor on the 2018 ticket with Kelly.

The written endorsement by the four elected officials pointed to Repass’ “electric energy and bold optimism” and an ability to engage a new generation of&nbsp;Kansas&nbsp;Democrats. They lauded Repass’&nbsp;commitment to building relationships among Democrats statewide.

“I’m a lifelong Democrat,” Repass told delegates. “I believe that we need to communicate with each other openly. We need to have transparency in everything we do. As your chair, nothing will be done in the dark. You will be a part of this every step of the way.”

Repass, who has worked as a radio station executive, said reelection of Kelly to a second term gave her hope in the future of Kansas politics. She said work of Democrats in the Legislature, which has a supermajority of Republicans, also inspired her. But division among Democrats across the state served to undermine the party’s potential, she said, because “a house divided against itself cannot stand.”

“We don’t have to like each other. I get that,” Repass said, “The people of Kansas need us to be allied and to stand firm for them.”

Repass’ mother was a civil rights activist and her father a veteran of the Vietnam war who worked in law enforcement after his military career. She said her parents instilled in her a belief that the right to vote shouldn’t be manipulated in a partisan manner to divide people.

Vicki Hiatt, who had served as party chair since 2019, decided against seeking another term when Repass disclosed her candidacy. Hiatt made her decision public after state Democratic Party executive director Ben Meers resigned in January amid allegations by former colleagues that he fostered a toxic work environment at the party’s Topeka office.

Rogers, the former state treasurer, lieutenant governor, senator and Wichita school board member, said he was well-equipped to take a leadership roll in the Democratic Party. He was appointed state treasurer by Kelly in 2021. In the November election, he lost a campaign to retain the post by 120,000 votes to Republican Steven Johnson.

“I have stepped up every time the Kansas Democrats have asked me to,” Rogers said. “I have heard from Kansans all over the state. They have the same message. We can’t keep doing the same thing and expect different results.”

He said his candidacy wasn’t about himself or Repass, who he said he “highly respected.” He said it was about preparing Democrats for the 2024 election cycle and the elections that would follow.

“Kansans deserve an alternative to the far-right extremists and cultural warriors who continue to take rights away and harm our future,” Rogers said. “I want a strong Democratic Party in all 105 counties.”

Earlier this month,&nbsp;<a target="_blank" href="https://kansasreflector.com/2023/02/11/kansas-republicans-select-2020-election-conspiracy-theorist-to-serve-as-party-chairman/">the Kansas Republican Party selected a new chairman</a>. Mike Brown, a former Johnson County Commission member who lost to Schwab in last year’s GOP primary for secretary of state, was chosen over Helen Van Etten, a former Republican national committewoman. Brown prevailed with 90 votes to Van Etten’s 88.
