City council to deal with another structure problem Tuesday

HUTCHINSON, Kan. — The public hearing on the structure at 3405 East 4th Ave. in Hutchinson is scheduled for Tuesday as part of the Hutchinson City Council meeting.

According to agenda documents, on July 11, 2024, the Interim Building Official and Fire Marshal met on-site and determined that the commercial property located at 3405 East 4th Ave. was in violation of City Code and determined to be unsafe for occupancy of the structure and was determined to be detrimental to the safety of the public and tenant.

The building has had a partial collapse, multiple electrical hazards, improper ventilation, no emergency lighting, improper exiting, no fire extinguishers, inoperable fire alarm and suppressions systems. The present tenant also does not have a valid/approved Certificate of Occupancy to legally occupy the structure. The property is owned by Pat Deveny, with a mailing address in Des Moines, lowa and consists of a one-story commercial warehouse, approximately 340,000 sq. ft.

The structure has contained a worm farm, which is not what it was approved to have when the Special Use Permit was issued on it in 2010 and it hasn't had a Certificate of Occupancy for at least four years.

City staff believes that the structure located at 3405 E 4th Avenue is beyond feasible repair, is unsafe and poses a danger to the surrounding neighborhood and should be condemned as an unsafe and dangerous structure.
